On June 23, in Hanoi, the Committee for Science, Technology and Environment and the Vietnam Union of Science and Technology Associations organized a workshop "Contributing opinions to complete the draft Law amending and supplementing a number of articles of the Architecture Law".
Mr. Vu Anh Tu - Deputy Director of the Department of Planning and Architecture (Ministry of Construction) said that the Architecture Law No. 40/2019/QH14 has contributed to the implementation of goals and requirements on perfecting institutions, policies, laws, and improving the effectiveness and efficiency of state management.
However, in the process of practical implementation, the Architecture Law has shown some existing and inadequate contents, so the development and promulgation of the Law amending and supplementing a number of articles of the Architecture Law is necessary.
The basic content of the draft Law aims to concretize and legalize regulations on architectural management authority and architectural practice in accordance with the organization of 2-level local government, requiring decentralization, delegation of power, and simplification of administrative procedures and processes.
In addition, the draft completes architectural management tools, especially architectural management regulations, architectural design competitions, meeting the requirements of innovation in construction and law enforcement to meet the requirements of national development in the new era.
At the workshop, some opinions mentioned the feasibility of directly decentralizing the authority to issue the Architectural Management Regulation to the commune-level People's Committee when the resources and human resources of the commune level are still limited. Feasibility and consequences of the "post-inspection" mechanism when abolishing the regulation on testing and testing to issue architectural practice certificates.
Delegates also contributed detailed opinions on architectural management regulations, regulations on applying building information models (BIM), architectural design competition mechanisms, green architecture management, sustainable architecture, and the role of socio-professional organizations in establishing capacity standards, continuous professional development (CPD).

Assoc. Prof. Dr. Luu Duc Hai - Director of the Institute for Urban Research and Infrastructure Development (General Association of Construction) affirmed that the draft Law amending and supplementing a number of articles of the Architecture Law is necessary to synchronize the legal system after the Land Law, Construction Law, and New Urban and Rural Planning Law are promulgated.
However, for this law to truly be effective, the Drafting Committee needs to further review and consolidate the amended clauses, clarifying the legal boundaries between the "Planning" and "Architecture" tools so as not to create new administrative barriers for people and businesses.
Mr. Vu Anh Tu - Deputy Director of the Department of Planning and Architecture affirmed that the Ministry of Construction will absorb the maximum in the process of completing the draft to report to the Committee for Science, Technology and Environment for consideration before submitting it to the National Assembly for consideration and approval right at the Extraordinary Session in August.
On behalf of the agency in charge of thẩm tra, Member, National Assembly Deputy working full-time at the Committee for Science, Technology and Environment Le Trung Thanh said that the Standing Committee will direct specialized units to fully summarize and study carefully to complete the thẩm tra Report, meeting the requirements of progress and quality to submit to the National Assembly Standing Committee and the National Assembly.
