Standards and conditions of the People's Public Security
The orientation of eliminating district-level police, increasing direct combat forces and comprehensively increasing commune-level police is the content that attracts much attention.
According to Lawyer Nguyen Trong Nghia - Hanoi Bar Association, based on Decree No. 42/2021/ND-CP, the establishment of a regular commune police is applied nationwide.
According to Article 17 of the Law on the People's Public Security (CAND) 2018, the Commune Police belongs to the organizational system of the CAND. Therefore, to become a commune police officer, it is necessary to meet the standards and conditions of the People's Public Security.
Article 7 of the 2018 People's Public Security Law stipulates the selection of citizens to the People's Public Security as follows:
Citizens who meet political standards, moral qualities, qualifications, health, age and ability suitable for public security work, have aspirations and the People's Public Security has a need can be recruited to the People's Public Security.
The People's Public Security is given priority in selecting students and excellent graduates from universities and vocational training institutions that meet the standards for training and addition to the People's Public Security.
Admission to the People's Public Security is being democratically implemented according to Decree No. 44/2021/TT-BCA.
Highest military rank of the Commune Police Chief
Regarding the salary level of the commune police, lawyer Nguyen Trong Nghia said that it is determined according to the military rank from the rank of non-commissioned officer to the rank of Lieutenant Colonel according to the salary coefficient specified in the salary table of the rank of People's Army officers; officers and non-commissioned officers of the People's Public Security issued with Decree No. 204/2004/ND-CP.
The salary of the commune police is calculated as follows: Salary = Salary coefficient x Basic salary.
According to the provisions of Clause 2, Article 3 of Decree No. 73/2024/ND-CP stipulating the basic salary and salary regime for cadres, civil servants and armed forces, from July 1, 2024, the basic salary applied is 2.34 million VND/month.
Therefore, from July 1, 2024, the salary of the commune police is specific according to the table below:
Regarding the title of Commune Police Chief, according to Article 5 of Decree No. 33/2023/ND-CP regulating commune-level cadres, civil servants and part-time workers at the commune level, in villages and residential groups, from August 1, 2023, the title of Commune Police Chief is not on the list of positions and titles of commune-level cadres and civil servants.
Instead, the Head of the Commune Police will be the title of the People's Public Security Forces, in line with the construction of a regular commune police force applied nationwide according to Decree No. 42/2021/ND-CP.
According to the provisions of the 2018 People's Public Security Law, the title of Chief of Commune, Ward and Town Police has the highest military rank of Lieutenant Colonel.
