On June 10, the Ministry of Public Security said that this agency has presided over the development and completion of the draft Law amending and supplementing a number of articles of 10 laws on administrative management related to the activities, functions and tasks of the People's Public Security force, including the Law on Road Traffic Order and Safety.
In this Law, the Ministry of Public Security believes that it is necessary to amend and supplement Clause 1, Article 64 of this Law in the direction of removing the regulation "the driving time of car drivers is not more than 48 hours in a week" but to revise in the direction of the working time of drivers in a week according to the provisions of the Labor Code;
The Ministry proposes to keep the regulation that the driving time of car drivers must not exceed 10 hours in a day and continuous driving must not exceed 4 hours.
The reason given by the Ministry is that according to the current proposal of the Transport Association and Transport Business Enterprises, the regulation of driving hours per week and continuous driving hours of the Law on Traffic Order and Safety is not in accordance with the general regulations of some countries in the region and makes it difficult for transportation activities and driver arrangement of enterprises to meet the requirements prescribed by the Law.
In addition, the Ministry of Public Security also proposed to amend and supplement Clause 2, Article 35 of this Law in the direction of supplementing the regulation that commercial vehicles used for transport must install a driver image recording device; Internal vehicles must install a journey monitoring device and a driver image recording device.
The reason is that transport business cars and internal transport vehicles must install journey monitoring devices and image recording devices for drivers.
This is to ensure that commercial vehicles are more strictly managed, serving the work of preventing and detecting violations of social order and safety on road vehicles, such as: Monitoring compliance with the law on traffic order and safety of drivers (using phones and electronic devices while driving, carrying more people than prescribed, not tying up a safety belt, letting both hands off the steering wheel, using the steering wheel control foot...);
detecting violations of social order and safety (attacks between passengers and drivers...), searching for criminals transported on transport business cars.
