The Government has just issued Decree 67/2025/ND-CP dated March 15, 2025 amending and supplementing a number of articles of Decree 178/2024/ND-CP on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing organizational restructuring.
Regime applied to 6 groups of agencies and units
Regarding the scope of regulation, the Decree stipulates policies and regimes for 6 groups of agencies and units.
First is the group of agencies of the Vietnam Cultural Party, the State, the Vietnam Fatherland Front, socio-political organizations at the central level, at the provincial level, at the district level and the armed forces.
Next is the group of administrative organizations of agencies and organizations from the central to district levels that directly implement the organizational arrangement or not directly implement the organizational arrangement but streamline the payroll and restructure, improve the quality of cadres and civil servants.
Public service units directly implement the organizational arrangement or not directly implement the organizational arrangement but implement staff streamlining, restructuring and improving the quality of civil servants.
Other public service units must complete the reorganization within 12 months from the date of the decision by the competent authority.
Agencies, organizations, and units due to the arrangement of administrative units at all levels.
The Party and State assigned the Parties to perform tasks at the central, provincial and district levels to reorganize, consolidate and merge the apparatus.
4 more groups of policy beneficiaries
The Decree adds 4 groups of beneficiaries of policies when streamlining the apparatus.
The first group is cadres, civil servants, public employees, and people working under labor contracts in agencies, organizations, units, and armed forces directly affected by the arrangement of the apparatus and administrative units at all levels.
This group is cadres, civil servants, and public employees who do not hold leadership or management positions; cadres, civil servants at the commune level; people working under labor contracts for certain types of work in administrative agencies and public service units according to the provisions of the labor law before January 15, 2019 and people working under labor contracts are subject to policies like civil servants.
Officers, professional soldiers, workers and defense officials of the Vietnam People's Army; officers, non-commissioned officers receiving salaries, police workers and contract workers receiving salaries from the state budget of the People's Public Security; key organizations.
Add new subjects such as civil servants, public employees in leadership and management in agencies, organizations and units as prescribed, with the prospect of resignation to create favorable conditions for the implementation of the arrangement of the number of cadres, civil servants and public employees in leadership and management according to the provisions of law in the implementation of the arrangement of the apparatus of the political system.
The second group is cadres, civil servants, public employees, and contractors receiving salaries from the state budget according to the provisions of law before January 15, 2019 and armed forces aged 5 years or younger to retirement age in agencies, organizations, and units that are not directly affected by the arrangement of the apparatus but must streamline the payroll, restructure, and improve the quality of cadres, civil servants, and public employees.
The third group is those who work within the staffing quota and receive salaries from the state budget at associations assigned by the Party and the State to be directly affected by the implementation of the arrangement, consolidation and merger of the apparatus.
The fourth group is cadres who are not old enough to be re-elected or reappointed as prescribed; cadres who meet the age requirements for re-election or reappointment at the same level, with working time from the date of congress organization from 2.5 years (30 months) to 5 years (60 months) to the retirement age prescribed by Decree 177 and cadres participating in Party committees at Party committees must complete their activities, and have 5 years (60 months) or less left until retirement age, and are at risk of early retirement to facilitate the arrangement of Party committee personnel in the Party Congresses at all levels towards the 14th National Party Congress and are approved by competent authorities.
