The Ministry of Home Affairs talks about the bonus regime for commune-level civil servants

According to the Ministry of Home Affairs, the subjects implementing the bonus regime have been clearly stipulated in Decree No. 73/2024/ND-CP dated June 30, 2024 of the Government.

Ms. Dinh Thi Que (character's name has been changed) is a civil servant on the payroll of the People's Committee of the commune in Cao Bang province. In the last 5 months of 2024, Ms. Que took maternity leave. The year-end assessment results of the unit assessed her as having completed the task well.

"So will I receive a Tet bonus at the same level as my other colleagues?" - Ms. Que wondered.

Regarding Ms. Que's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.

According to the Ministry of Home Affairs, the subjects implementing the bonus regime have been clearly stipulated in Clause 1, Article 4 of Decree No. 73/2024/ND-CP of the Government.

Implement the bonus regime based on outstanding work achievements and results of assessment and classification of annual task completion levels for subjects specified in Clause 2, Article 2 of this Decree.

Accordingly, salary recipients specified in Points a, b, c, d, dd, e, g and h, Clause 1 of this Article (excluding beneficiaries of allowances and living expenses) are subject to the bonus regime:

a) Cadres and civil servants from central to district levels specified in Clause 1 and Clause 2, Article 4 of the Law on Cadres and Civil Servants 2008 (amended and supplemented by the Law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees 2019);

b) Commune-level cadres and civil servants as prescribed in Clause 3, Article 4 of the Law on Cadres and Civil Servants 2008 (amended and supplemented by the Law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees 2019);

c) Officials in public service units as prescribed in the Law on Public Employees 2010 (amended and supplemented by the Law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees 2019);

d) People working under the labor contract regime as prescribed in Decree No. 111/2022/ND-CP dated December 30, 2022 of the Government on contracts for a number of types of work in administrative agencies and public service units that are subject to application or have agreed in the labor contract to apply salary classification according to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces;

d) People working within the staffing quota of associations receiving state budget support for operating expenses as prescribed in Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government regulating the organization, operation and management of associations (amended and supplemented in Decree No. 33/2012/ND-CP dated April 13, 2012 of the Government);

e) Officers, professional soldiers, workers, national defense officials and contract workers of the Vietnam People's Army;

g) Salary-paying officers and non-commissioned officers, police workers and contract workers under the People's Public Security;

h) People working in key organizations;

The bonus regime is specified in Article 4 of Decree No. 73/2024/ND-CP; In which, the head of the competent authority manages or is decentralized to manage cadres, civil servants and heads of public non -business units shall formulate specific regulations to implement the bonus regime applicable to the subjects on the salary list of agencies and units.

The organization and implementation of policies for cadres, civil servants and public employees in Cao Bang province is under the authority of the Provincial People's Committee.

Therefore, the Ministry of Home Affairs recommends that Ms. Que contact the agency managing cadres, civil servants and public employees of Cao Bang province (Department of Home Affairs) for answers.
