Ministry of Home Affairs proposes tasks on salaries and social insurance

The Ministry of Home Affairs proposes to add 2 tasks in the fields of labor, wages and social insurance according to the draft Decree being appraised by the Ministry of Justice.

The Ministry of Justice is appraising the draft Decree stipulating the functions, tasks, powers and organizational structure of the Ministry of Home Affairs.

Notably, the Ministry proposed to supplement 2 tasks in the fields of labor, wages and social insurance (BHXH) at point b, clause 11, Article 2 to ensure compliance with the provisions of Article 43 of the 2019 Labor Code and at point h, clause 11, Article 2 to ensure compliance with the provisions of Article 133 and Article 136 of the Law on Social Insurance No. 41/2025/QH15;

Accordingly, in the field of labor, wages and social insurance, the Ministry of Home Affairs proposes to have the task of helping the Government unify state management of labor, wages and social insurance according to the provisions of law;

Along with that, guiding and organizing the implementation of legal regulations on labor contracts, labor discipline, material liability, dialogue at the workplace, collective bargaining, collective labor agreements and settlement of labor disputes; labor policies in cases of division, separation, merger, sale, lease, conversion of business types, transfer of ownership rights, asset use rights, dissolution, bankruptcy of enterprises, cooperatives, in the rearrangement and conversion of state-owned enterprises.

Guiding the implementation of labor law regulations for female workers, juvenile workers, elderly workers, workers with disabilities, domestic helpers and some other workers;

The Ministry of Home Affairs also proposed guidance on registration and state management of the activities of labor representative organizations in accordance with the provisions of labor law; performing the task of a national focal point in the field of labor during Vietnam's participation in international trade agreements;

Guiding the implementation of legal regulations on policies, salary regimes, allowances, living expenses, and bonuses for cadres, civil servants, public employees from central to commune level and contract workers in state agencies and public non-business units;

Guiding the implementation of legal regulations on the minimum wage and salary policies for employees in enterprises, agencies, organizations, cooperatives, households, and individuals who hire and use labor according to the provisions of the Labor Code;

In particular, the Ministry proposes a task to guide on salaries, bonuses and remuneration for employees and managers in state-owned enterprises and enterprises with state-invested capital;

Advising on building, promulgating and directing, guiding, and inspecting the implementation of policies and laws on social insurance; propagating, disseminating, and educating on social insurance laws; implementing statistics and information work; organizing training, fostering, training, scientific research and international cooperation on social insurance;

Research and advise competent authorities on the implementation of salary policy reform and social insurance policy.

According to the draft submission, the Ministry of Home Affairs proposes to basically maintain the organizational structure of the Ministry of Home Affairs as stipulated in Article 3 of Decree No. 25/2025/ND-CP.

The organizational structure of the Ministry of Home Affairs has been arranged and streamlined in the process of merging the Ministry of Home Affairs and the Ministry of Labor, Invalids and Social Affairs. Accordingly, 37.14% of units under and directly under the Ministry have been reduced (reduced from 35 units to 22 units).
