Ministry of Home Affairs explains proposal for 5 years of work when receiving civil servants

According to the Ministry of Home Affairs, the regulation of a minimum of 5 years of service when receiving civil servants is aimed at ensuring the quality of the staff in accordance with current regulations and practices.

At the Q1/2026 press conference organized by the Ministry of Home Affairs on the afternoon of April 28, answering reporters of Lao Dong Newspaper regarding the basis for proposing regulations on receiving civil servants with the condition of having at least 5 years of service, Mr. Nguyen Xuan Tu - Deputy Director of the Department of Civil Servants and Public Employees (Ministry of Home Affairs) said: Implementing the Law on Cadres, Civil Servants and the Law on Public Employees in 2025, the Government has issued Decree No. 170 regulating the recruitment, use and management of civil servants.

In which, Article 13 of Decree No. 170 stipulates that in cases of having experience, being admitted to civil service must have 5 years of service or more.

The regulation of the condition of having 5 years of working experience in the Draft Decree of the Government amending and supplementing Decree No. 170/2025 is a continuation of previous regulations of the Law on Cadres and Civil Servants in 2008, the Law amending and supplementing the Law on Cadres and Civil Servants in 2019 and related documents of the Government.

This regulation aims to ensure the quality of the civil servant team when receiving cases working in agencies, organizations, and units with different functions and tasks to become civil servants.

This is a form of reception for cases with practical experience, different from the form of exam or admission according to current regulations" - Mr. Nguyen Xuan Tu said.

Continuing to maintain regulations on 5-year working conditions is to ensure the inheritance and synchronization of the legal system and improve the quality of human resources in the public sector.

Implementing the Government's Action Program to implement the Resolution of the XIV Congress, in Resolution No. 41 dated March 11, 2026, the Government has identified the task of completing job position projects associated with restructuring and improving the quality of the CBCCVC team.

On that basis, based on the Law on Cadres and Civil Servants in 2025 and the Law on Public Employees in 2025, the Government has issued Decree No. 361/2025 regulating civil servant positions.

For the civil servant sector, the Law on Civil Servants takes effect from June 1, 2026. Currently, the Ministry of Home Affairs is summarizing and submitting to the Government for promulgation regulations on the job positions of civil servants in April 2026.

According to regulations on job positions for CBCCVC, ministries, branches, and localities are responsible for directing agencies, organizations, and units under their management to determine job positions; build job descriptions and competency frameworks for each position to arrange civil servants and public employees in accordance with the job positions of their agencies, organizations, and units.

This is one of the important solutions to improve the quality and restructure the CBCCVC team, meeting the requirements of tasks in the new period.

At the same time, along with reforming the salary policy for the public sector, it will ensure legitimate rights for CBCCVC; maintain working motivation and limit brain drain in the public sector" - Mr. Nguyen Xuan Tu emphasized.
