The Ministry of Home Affairs has completed and sent its opinions on the draft Submission and draft Law on Cadres and Civil Servants as amended. The bill is expected to be submitted to the National Assembly at the upcoming 9th session.
The basic content of the draft Law consists of 8 chapters and 47 articles.
In the draft, the Ministry of Home Affairs proposes to add Chapter III to specify the content of job positions, including 4 articles (from Articles 11 to 14) on the concept of job positions, classification of job positions; basis for determining job positions; change of job positions and content for management of job positions.
According to the draft, the concept of job position has 2 options, including:
Option 1: Job position is the name to determine the tasks of a specific job associated with the professional title or leadership and management position, built on the basis of functions, tasks and organizational structure of the agency, organization, unit, as the basis for recruiting, using, and managing the team.
Option 2: Job position is the name of the professional and technical civil servant title or leadership and management position, associated with work and position in the agency, organization, unit, tasks, responsibilities, authority and specific results and products.
The structure of the job position includes: Name; job description; responsibilities, tasks, powers; capacity framework (knowledge, skills, ability to meet work requirements, ...).
Notably, the Ministry of Home Affairs proposed to classify job positions including: Staff job positions; leadership and management job positions; Professional and technical job positions; Support and service job positions.
The principle of determining job positions must be consistent with the organizational structure and operations of agencies, organizations and units with similar functions and tasks; ensure science, objectivity, publicity, transparency, democracy and suitability with reality; ensure unity and synchronization in the recruitment, arrangement, use and management of cadres and civil servants according to job positions.
