Mr. Bui Van Binh (character's name has been changed) said that according to the provisions of Chapter II of Decree No. 150/2025 of the Government on the organization of specialized agencies under the People's Committees of provinces and centrally run cities and People's Committees of communes, wards and special zones, specialized agencies under the People's Committees at the commune level include: People's Council and People's Committee Office; Economic, Infrastructure and Urban Affairs Department; Department of Culture - Society.
According to Mr. Binh, this regulation raises the issue that needs to be clarified: The specialized departments are responsible for directly advising the People's Committee in drafting documents such as reports, plans, etc., or only the People's Council and People's Committee offices are assigned the task of advising on drafting. His point of view is that all three agencies above must perform the function of advising and assisting the Ward People's Committee.
He gave an example: when the Provincial People's Committee or departments and branches require the Ward People's Committee to develop a plan or report under the functions and tasks of the Department of Economy, Infrastructure and Urban Areas or the Department of Culture - Social Affairs, it is necessary to clearly define the process. Whether these departments directly advise the People's Committee leaders to draft documents to submit to the Chairman or Vice Chairman of the People's Committee for signing, or only develop documents at the department level (signed by the Head of the Department) to send to the People's Committee, then the People's Council Office and the People's Committee are responsible for completing them into official documents of the People's Committee for the leaders to sign.
Mr. Binh requested that the authorities respond clearly so that the locality has a basis for unified implementation.
Regarding this issue, the Ministry of Home Affairs responded on the Electronic Information Portal.
Accordingly, the functions and tasks of the specialized department under the People's Committee at the commune level shall comply with the provisions of Decree 150/2025 and the decision of the People's Committee at the commune level for each department according to its authority.
Article 11 of the Decree clearly states that the department is a specialized agency under the People's Committee at the commune level; performs the function of advising and assisting the People's Committees at the commune level in state management of local sectors and fields according to the provisions of law.
The Department under the People's Committee at the commune level is subject to the direction and management of the apparatus organization, job positions, civil servant payroll, civil servant rank structure, number of employees, and civil servant structure according to professional titles in public service units and work of the People's Committee at the commune level, and is subject to the direction, inspection and guidance on professional expertise of the professional agency under the Provincial People's Committee.
Meanwhile, Article 12 of the Decree clearly states the tasks and powers of the department, in which the department has the right to submit to the People's Commune-level People's Committee draft resolutions and decisions related to the department's field; draft plans and programs; perfect the organization of the department apparatus; perform professional management.
Specialized departments are organized at the commune level to advise and help the People's Committees of communes perform the function of state management in specific areas as stipulated in Article 13 of the Decree.
