The Ministry of Home Affairs received a speech from the Department of Home Affairs of Ha Tinh province on a number of difficulties, problems, implementation solutions and initial experience of Ha Tinh province in organizing and operating the 2-level local government model.
Accordingly, the Department of Home Affairs of Ha Tinh province proposed that the Central Government continue to improve the legal system according to the model of local government at 2 levels across sectors and fields to create a favorable legal corridor for localities to implement.
Strengthen guidance, support and assistance to localities in implementing decentralized and delegated tasks in the current period.
The Department requests the Ministry of Home Affairs to give its opinion to the Central Organizing Committee to advise on amending relevant regulations of the Politburo on personnel work, especially regulations on decentralization of personnel management and appointment and introduction of candidates; regulations on equivalent titles and regulations on evaluation of cadres, civil servants, public employees...
Continue to guide the settlement of regimes, policies, arrangements and use for part-time workers at the commune level when arranging administrative units and local government organizations at 2 levels.
Issue a Circular guiding Decree No. 179/2024/ND-CP, especially new and difficult contents related to promoting the use of talented people (standards, conditions and procedures for recognizing talented people) so that localities across the country can unify the implementation process.
In particular, the Department proposed that the Ministry of Home Affairs guide the establishment of public service units under the People's Committees at the commune level, especially public service units providing basic and essential public services at the commune level.
Mr. Phan Trung Tuan - Director of the Department of Local Government, Ministry of Home Affairs commented that some localities are still facing difficulties in implementing regulations related to the authority to establish professional agencies and other administrative organizations at the commune level; public service units at the commune level; or the authority to appoint, dismiss, or remove from the positions of heads and deputy heads of public service units.
Mr. Tuan analyzed that the main reason is the lack of consistency between the provisions of the Law on Organization of Local Government and the Government's decrees on decentralization, delegation of authority and determination of authority.
On this issue, Mr. Tuan said that the Ministry of Home Affairs is coordinating with ministries and branches to have specific instructions.
