The Ministry of Home Affairs has sent an official dispatch to the Ministry of Finance on the payment of policies and regimes according to Decree No. 178/2024.
In the document sent to the Ministry of Home Affairs, the Ministry of Finance mentioned three remaining problems in the process of paying benefits for civil servants who retire early according to Decree 178/2024 and Decree 67/2025, and at the same time recommended that the Ministry of Home Affairs guide them to resolve them.
First, for those who have retired or quit before August 31, the budget-using units have been assigned sufficient estimates for implementation. However, payment records sent to the State Treasury after September 1 no longer have a legal basis for payment, leading to a deadlock in the implementation of workers' rights.
Second, for those who have decided to retire or quit before August 31 but the budget estimate has not been allocated to the unit in time, the payment must comply with the allocation process, and when there is an estimate, the Decree will be stuck in the effective date of the Decree, making it impossible for the State Treasury to disburse.
Third, in the case of people taking a leave from September 1 to December 31, there will be confusion: If the payment is made according to the leave period, it may violate regulations, but if they wait until the new Decree takes effect, the employee will have to wait a longer time, affecting their rights.
Responding to the document of the Ministry of Finance on the payment of policies and regimes according to Decree No. 178/2024 (amended and supplemented in Decree No. 67/2025), the Ministry of Home Affairs said that Document No. 322 of the Government Party Committee assigned the Ministry of Home Affairs to "prise the charge and coordinate with the Ministry of Finance, agencies and localities to direct and guide policies and regimes for cadres and civil servants affected by the organizational arrangement before August 31, 2025; after this time, it will end; report to the Government on the implementation results before August 31, 2025".
Based on Conclusion No. 183 of the Politburo, the Secretariat on the implementation of the 2-level local government model and the assigned tasks in Document No. 322 of the Government Party Committee, the Ministry of Home Affairs issued Document No. 6383 to ministries, departments, branches and localities on the implementation of Conclusion No. 183, in which specific instructions on subjects of application, time and responsibility for resolving policies and regimes.
Regarding the payment of policies and regimes, Document No. 322 assigned the Ministry of Finance to "prise the lead and coordinate with the Ministry of Home Affairs, agencies and localities to direct, guide, and promptly arrange funding, and completely resolve the policies and regimes for cadres and civil servants affected by the organizational arrangement before August 31, 2025; after that time, it will end; report to the Government on the implementation results before August 31, 2025".
Therefore, the Ministry of Home Affairs requests the Ministry of Finance to guide and be responsible for paying policies and regimes according to the provisions of law on state budget management, ensuring the completion of policies and regimes for subjects in accordance with the direction of the Politburo and the Secretariat in Conclusion No. 183.
During the implementation process, facing difficulties and obstacles, the Ministry of Home Affairs requested the Ministry of Finance to report to competent authorities for consideration and decision.
