The Ministry of Home Affairs is seeking opinions on the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH).
Notably, in the draft submission, the Ministry of Home Affairs proposed to amend some contents related to the arrangement of the 2-level local government organization.
Accordingly, studying the provisions of the Law on Organization of Local Government No. 72/2025/QH15, the drafting agency found that this Law no longer specifically stipulates the non-specialized activities at the commune, village, and residential group levels, but stipulates "non-specialized activities enjoy allowances from the state budget".
To ensure uniformity in the legal system, the draft amended Law stipulates at point k, clause 1, Article 2 as follows: "Non-specialized personnel enjoying allowances from the state budget" (formerly stipulated as non-specialized personnel at the commune level, in villages, residential groups) are subject to compulsory social insurance participation.
In addition, to ensure compliance with the principle of delineating the authority of local authorities, decentralization and delegation of power in the Law on Organization of Local Government; in order to enhance the effectiveness of state management of social insurance in localities, the draft Law has amended Article 138 in the direction of: Clearly stipulating the responsibilities of provincial-level People's Committees and commune-level People's Committees in state management of social insurance;
In accordance with the tasks and powers of the Provincial People's Council in deciding policies and measures on ensuring local social security; stipulating the responsibilities of the commune-level People's Committee in accordance with the capacity and conditions for performing tasks of the commune-level government.
According to the Summary Report on the implementation of the Law on Social Insurance No. 41/2024/QH15 of the Ministry of Home Affairs, the 2024 Law on Social Insurance has supplemented subjects eligible for compulsory social insurance participation for a number of subjects, including non-specialized workers in villages and residential groups.
As of the end of February 2026, the number of new subjects who have participated in compulsory social insurance such as business household owners is 36,090 people; subjects who are managers and representatives without salary are 60,304 people; standing militia are 22,679 people; non-specialized workers in villages and residential groups are 22,822 people; people working part-time are 150,000 people. Accordingly, the total number of participants of new subject groups in 2025 is nearly 292,000 people.
