On November 13, the National Assembly discussed in the hall the draft Law on Civil Servants (amended). Minister of Home Affairs Do Thanh Binh explained and clarified a number of issues of concern to delegates.
The Minister said that some delegates suggested considering not regulating the organization and operation of public service units in Article 5 of the draft law but should let the law on organization and operation of public service units (PPUs) regulate it.
However, during the time before the law on the organization and operation of the Vietnam Deposit Insurance Corporation was issued, it was proposed that the National Assembly keep the provisions in the draft law as a basis for the documents under the law to have a basis for promulgation and maintain stability in the operation of the public enterprise.
Many delegates were interested in innovating the mechanism for management and use of civil servants, taking job positions as the center to carry out the recruitment, use, evaluation, and classification of civil servant quality, implementing regimes and policies on salaries, bonuses and other policies related to the civil servant team.
In response to the comments, the Ministry of Home Affairs will review the provisions on recruitment bases; recruitment principles; recruitment methods and the contents of the regulations on job positions in the draft law.
Regarding the authority to recruit civil servants, at this session, the Government also submitted to the National Assembly a draft Resolution of the National Assembly on a number of specific and outstanding mechanisms and policies to implement breakthroughs in education and training development.
Including regulations on the authority to recruit civil servants who are teachers in public educational institutions; at the same time, stipulating that in cases where there are differences in the same content between this Resolution and the law, the provisions of this Resolution shall apply.
Therefore, specific regulations for teachers will be implemented according to the provisions of this Resolution. For other contents, the Ministry of Home Affairs coordinates with agencies to review and ensure consistency between the draft law and the provisions of specialized civil servant management laws.

Another content is to allow civil servants to sign labor contracts or service contracts to carry out professional activities with agencies and organizations other than the Vietnam Bank for Industry and Trade.
According to the Minister, the delegates' opinions were highly unanimous with the policy of allowing civil servants to sign labor contracts and work contracts to create a mechanism for connecting human resources between the public and private sectors; at the same time, creating conditions for civil servants to increase their legitimate income from their labor force.
In response to the opinions, the Ministry of Home Affairs will review and revise to ensure the principle of creating maximum conditions for civil servants in professional activities but at the same time must also ensure transparency, not allowing conflicts of interests and policy profiteering.
Regarding the assessment and classification of civil servants, many delegates were interested in the assessment method, ensuring that the assessment must be substantial on the principle of being linked to products and results of performing tasks; quantity, objectivity, and multidimension.
The Ministry of Home Affairs will review and revise to stipulate the principles and authority for assessment to ensure regularity, continuity, and multidimension based on results, quality of public service and people's satisfaction; apply digital technology, build a national database on civil servants to ensure publicity and transparency in evaluating, managing and developing civil servant teams.
