On September 3, according to the Ministry of National Defense's Electronic Information Portal, this agency has just received a petition from voters of An Giang province sent after the 9th Session of the 15th National Assembly.
In which, voters in localities proposed to have a policy to arrange Deputy Commanders of the Military Command (CHQS) in communes that had been trained at the Military University before the merger to continue working at the Commune Military Command after the merger.
Regarding this content, the Ministry of National Defense said that points a, b, d, Clause 9, Article 10 of the Law amending and supplementing a number of articles of the 11 Laws on military and defense in 2025, stipulates:
1. The commander is a civil servant, member of the People's Committee at the commune level, a reserve officer; in a state of national defense emergency, during war, called up to serve in the army according to the provisions of the Law on Officers of the Vietnam People's Army and continues to hold the position of Commander of the Military Command at the commune level;
2. Deputy Commander and Assistant are civil servants;
3. The Government stipulates the job positions for Commanders, Deputy Commanders and Assistants; the number of Deputy Commanders and Assistants; standards and norms for working equipment of the Military Command at the commune level.
Point a, b, Clause 2, Article 5 of Decree No. 220/2025/ND-CP dated August 7, 2025 of the Government also stipulates the number of Deputy Commanders and Assistants of the Military Command at the commune level as follows:
1. Key commune-level administrative units in defense are arranged with no more than 2 Deputy Commanders and 1 Assistant;
2. Commune-level administrative units not falling under the provisions of Point a, Clause 1 of this Article shall have 1 Deputy Commander and 1 Assistant.
The Law amending and supplementing a number of articles of 11 Laws on military and defense in 2025 also stipulates instructions on planning, training, fostering, and arranging the use of military police officers at the commune level:
The Ministry of Home Affairs shall preside over and coordinate with the Ministry of National Defense and the Ministry of Finance to direct and guide localities, agencies and organizations relevant in planning, training, fostering, and arranging the use of Commanders, Deputy Commanders, and Assistants of the Military Command at the commune level; on implementing regimes and policies for the positions of the Military Command at the commune level.
The Ministry of National Defense also said that in order to promptly implement legal regulations on militia and self-defense forces, this agency also issued Official Letter No. 4798/BQP-TM dated August 6, 2025 on resolving difficulties and problems of localities in implementing the 2-level local government model to the Ministry of Home Affairs and People's Committees of provinces and centrally run cities.
"Therefore, the arrangement and assignment of Deputy Commanders of the Military Command at the commune level (before the merger) who have been trained at the university level in the military sector and continue to work at the Military Command at the commune level; request the People's Committee of An Giang province to pay attention to directing, selecting and recruiting them to the positions of the Military Command at the commune level (after the merger) in accordance with the provisions of the system of legal documents on militia and self-defense forces and meeting the requirements of military and defense tasks in the locality" - the Ministry of National Defense informed.
