On January 21, the Government Office announced that the Government has just issued Resolution 14/NQ-CP on the specialized meeting on law making in January 2025.
Regarding the draft Resolution of the National Assembly on the establishment of a number of ministries on the basis of reorganizing a number of ministries of the Government of the 15th National Assembly term and the draft Resolution of the National Assembly on the structure of Government members of the 15th National Assembly term:
The Government agrees on the necessity of developing and promulgating Resolutions on the establishment of a number of ministries on the basis of reorganizing a number of ministries of the Government of the 15th National Assembly term and the structure of Government members of the 15th National Assembly term.
The Government assigned the Ministry of Home Affairs to continue completing the draft Resolutions in the following directions:
- Determine the names of ministries and agencies in accordance with the decisions of competent authorities.
- Regarding the Government membership structure, there are only principled regulations on Deputy Prime Ministers; the specific number of Deputy Prime Ministers is determined based on the practical situation of each period.
Regarding the draft Law on Government Organization (amended), the Government highly appreciates the Ministry of Home Affairs for proactively presiding over and coordinating with relevant ministries and agencies to complete the draft Law on Government Organization (amended).
The Government agrees on the necessity of developing a Law to create a legal framework for perfecting the Government's organizational structure, innovating and arranging the state administrative apparatus to be "streamlined - compact - strong - effective - efficient - effective", meeting the requirements of building and perfecting the socialist rule-of-law State of Vietnam in the new situation.
The Ministry of Home Affairs studies and absorbs as much as possible the opinions of Government members, relevant ministries and agencies, and completes the draft law dossier.
The draft law needs to focus on harmoniously, reasonably, effectively, clearly and specifically resolving the relationship between Government agencies including the Government, Prime Minister, Ministers, Heads of ministerial-level agencies, ministries and ministerial-level agencies; between Government agencies and central agencies such as the National Assembly, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy... and between Government agencies and local authorities.
Review and fully institutionalize the Party's policies, perfect regulations on the tasks and powers of the Government and the Prime Minister, ensuring comprehensiveness, comprehensiveness, and strictness, correctly reflecting the position and functions of the Government and the Prime Minister as stipulated in the Constitution.
Decentralization and delegation of authority must be associated with ensuring resources, promoting the responsibility of leaders, strengthening inspection and supervision of implementation, in which it is important to clearly identify tasks and powers that are not decentralized and tasks and powers that need to be further decentralized or delegated.
At the same time, the principled provisions on decentralization, delegation of authority, and authorization serve as a legal basis for the Government to make decisions in accordance with practical conditions.
The Ministry of Home Affairs shall preside over and coordinate with the Ministry of Justice, the Government Office and other ministries and agencies to urgently study and fully absorb the opinions of Government members at the meeting to revise and complete the draft Law on Government Organization (amended).
At the same time, continue to complete the draft Law dossier and follow the procedures prescribed by the Law on Promulgation of Legal Documents to send for comments to Government members, ensuring quality, progress, and timely submission to the National Assembly at the 9th Extraordinary Session, February 2025.
