Proposal to supplement fire prevention regulations for high-rise apartments
Speaking at the meeting, delegate Vu Hong Luyen (National Assembly Delegation of Hung Yen province) said that many high-rise apartment buildings were built a long time ago, and during use, the technical systems were damaged or repaired, leading to fire prevention, fire fighting, and rescue work no longer being guaranteed.
According to the Delegate, there should be regulations on the traffic system leading to high-rise apartment buildings to ensure that specialized fire prevention and rescue vehicles can at least access it when a fire or explosion occurs.
Delegate Nguyen Lam Thanh (National Assembly Delegation of Thai Nguyen Province) said that in fact, recently, many fires have occurred due to electrical short circuits and welding, related to karaoke bars and dance clubs... Therefore, the contents related to these groups need to be closely reviewed to ensure fire prevention and fighting work.
According to this delegate, in reality, we are currently only accessing a separate water source from ponds, rivers, and lakes for fire fighting. Meanwhile, we have not yet accessed the water source of families from top to bottom to handle the issue of fire fighting flexibly and promptly.
Clear responsibility in fire prevention
Regarding the content on the responsibilities of agencies, organizations, households and individuals in fire prevention and fighting and search and rescue activities, delegate Nguyen Minh Tam (National Assembly Delegation of Quang Binh province) expressed his opinion that Article 7 of the draft Law stipulates that the head of the facility is responsible for establishing and maintaining the operation of the Fire Prevention and Fighting and Search and Rescue Team, facility rescue or specialized Fire Prevention and Fighting and Search and Rescue Team or assigning people to perform fire prevention and fighting and search and rescue tasks within the scope of management according to the provisions of law.
Meanwhile, Article 22 stipulates fire safety conditions for facilities, also requiring the establishment of a fire prevention and fighting and rescue force for facilities or a specialized fire prevention and fighting and rescue force for facilities according to the provisions of law. At the same time, Clause 4, Article 37 proposes that the Government stipulates that facilities must establish a fire prevention and fighting and rescue team for facilities, and facilities must establish a specialized fire prevention and fighting and rescue team.
According to the delegate, there is no consistency between the provisions of the draft Law, and it is not clear in which cases the facility only needs to assign people to perform fire prevention and fighting and search and rescue tasks without establishing a facility fire prevention and fighting and search and rescue team or a specialized fire prevention and fighting and search and rescue team. Therefore, the drafting agency needs to review and revise these provisions to ensure consistency.
Sharing the same opinion on this issue, delegate Tran Dinh Chung (Da Nang National Assembly Delegation) proposed to supplement the responsibilities of relevant parties during the construction process. Article 18 stipulates that construction works must ensure fire safety conditions during construction, but the draft has not yet specified the responsibilities of relevant parties. Therefore, it is necessary to supplement the fire safety responsibilities of relevant parties during construction, including: Facility owners, individuals, construction units, supervision consultants and design appraisal.
Sharing the same view, delegate Do Ngoc Thinh (National Assembly Delegation of Khanh Hoa Province) said that Article 7 of the draft Law stipulates the responsibilities of agencies, organizations, households and individuals in fire prevention and fighting and search and rescue activities. However, this article has not yet clearly stated the responsibilities of heads of agencies, organizations and households.
"It is proposed to add to Clause 3 of this Article the content: the head of an agency, organization, or household must take primary responsibility for fire prevention in case a fire occurs at his or her agency, organization, or household" - delegate Do Ngoc Thinh emphasized.
