Pursuant to Decree 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the reorganization of the apparatus of the political system, Ms. Le Xuan Minh (character's name has been changed) in Hung Yen voluntarily submitted an application for early retirement.
Ms. Minh's salary will be raised 12 months ahead of schedule from level 4, salary coefficient 5.42 to level 5, salary coefficient 5.76 from June 1, 2022. By the end of May 2025, she will have 36 months to increase her salary regularly.
"If I apply for early retirement under Decree No. 178/2024/ND-CP, will I be able to increase my salary before the deadline according to Clause 2, Article 3 of Circular 08/2013/TT-BNV dated July 31, 2013 of the Ministry of Home Affairs? We would like to ask the Ministry of Home Affairs to clarify and help, I would like to express my sincere thanks" - Ms. Minh wondered.
Regarding Ms. Le Xuan Minh's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
According to the Ministry of Home Affairs, the regime of early salary increase is specifically guided in Article 3 of Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Minister of Home Affairs guiding the implementation of the regime of regular salary increase and early salary increase for cadres, civil servants, public employees and workers (amended and supplemented in Circular No. 03/2021/TT-BNV dated June 29, 2021 of the Minister of Home Affairs).
Standards and levels on achieving excellent results in performing tasks and the time for early salary increase corresponding to each different level of achievement of cadres, civil servants, public employees and workers are discussed by the head of the agency, unit managing cadres, civil servants, public employees and workers with the Party Committee and the Executive Committee of the same-level trade union, specifically stipulated in the Regulations on early salary increase of the agency or unit.
Based on this regulation, cadres, civil servants, public employees and workers eligible for annual early salary increase voted by the collective, but each year not exceeding 10% of the total number of cadres, civil servants, public employees and workers on the salary list of the agency or unit.
Clause 2 of this Article clearly states the regime of early salary increase for cadres, civil servants, public employees and workers who have been notified of retirement:
Cadres, civil servants, public employees and workers who have announced their retirement, if they have met the 2 criteria specified in Clause 2, Article 2 of this Circular during their tenure and have not been ranked in the final salary level in the rank or in the title and from the date of the announcement of retirement until the date of retirement there is a shortage of 12 months or less to receive a regular salary increase according to regulations, will be raised to the salary level 12 months before the time specified in Point a, Clause 1, Article 2 of this Circular.
Accordingly, from the date of retirement announcement to before retirement date, cadres, civil servants, public employees and workers who are still 1 to 12 months short of being entitled to regular salary increase according to regulations will be entitled to a salary increase 12 months before the retirement date.
The organization and implementation of policies for cadres, civil servants and public employees in Hung Yen province is under the authority of the Provincial People's Committee.
Therefore, the Ministry of Home Affairs has asked her to contact the agency managing cadres, civil servants and public employees of Hung Yen province (Department of Home Affairs) for answers.
