Mr. Le Van Xuan (character's name has been changed) is working for an agency in Hanoi to study Circular 03/2021/TT-BNV regulating not to increase salary grades twice in a row ahead of schedule due to outstanding achievements in performing tasks.
Mr. Xuan questioned the following case: On December 31, 2019, the specialist decided to increase salary 9 months ahead of schedule. The time frame for calculating the next salary grade is December 9, 2019.
On December 21, 2022, the specialist was appointed and salary was classified as a senior specialist, the time frame for calculating the next salary increase is November 1, 2022.
In 2025, the main specialist will be promoted ahead of schedule.
"So, is there a violator who violates the regulation of not raising the salary level twice in a row due to excellent achievements in performing tasks in 2025?" - Mr. Xuan asked.
Regarding the reflection and recommendation of Mr. Le Van Xuan, the Ministry of Home Affairs has responded on the Electronic Information Portal.
According to the Ministry of Home Affairs, the regime of early salary increase is specifically guided in Article 3 of Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Ministry of Home Affairs guiding the implementation of the regime of regular salary increase and early salary increase for cadres, civil servants, public employees and workers (amended and supplemented in Circular No. 03/2021/TT-BNV dated June 29, 2021 of the Ministry of Home Affairs).
Article 3 clearly states the determination of achievements to consider early salary increase due to excellent achievements:
The achievements for considering early salary increase are determined according to the time of issuance of the decision to recognize achievements achieved in the most recent 6 years for positions requiring college training level or higher and the most recent 4 years for positions and positions requiring intermediate training level or lower as of December 31 of the year of considering early salary increase.
In particular, in cases where the salary level has been increased ahead of schedule, all achievements achieved before the date of the decision to increase the salary level ahead of schedule within the period (6 years and 4 years) specified in this Point will not be counted for consideration of raising the salary level ahead of schedule for the next time.
The consideration of early salary increase is based on the highest achievements of cadres, civil servants, public employees and workers; if the highest achievements are equal, other achievements will be considered; in case there are many people with similar achievements, priority will be given according to the regulations on early salary increase of the agency or unit.
The organization and implementation of policies for cadres, civil servants and public employees in Hanoi city is under the authority of the City People's Committee.
