Mr. Duong Van Quoc (name of the person changed) said that he is currently a specialist in the Economic, Infrastructure and Urban Department under the Ward People's Committee, working under labor contracts to perform civil service duties according to Decree No. 173/2025/ND-CP dated June 30, 2025 of the Government.
According to Mr. Quoc, so far there has been no circular or legal document specifically regulating the allowance and bonus regime for people working under labor contracts performing civil service tasks according to Decree No. 173/2025/ND-CP.
Meanwhile, this decree only clearly stipulates for the group of contract workers according to Decree No. 111/2022/ND-CP.
From the above reality, Mr. Quoc proposed that competent authorities soon issue legal documents clearly stipulating the salary, allowance and bonus regime for people working under labor contracts performing civil service tasks according to Decree No. 173/2025/ND-CP, in order to ensure rights and unity in the implementation process.
Regarding Mr. Quoc's reflection and recommendations, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Clause 2, Article 10 of Decree No. 173/2025/ND-CP dated June 30, 2025 of the Government stipulates that individuals signing contracts (workers) clearly state:
Fully and on time implement, ensuring the quality of professional and nghiep vu tasks as agreed in the contract and other requirements of agencies, organizations, and units signing contracts (if any); be responsible before the law and agencies, organizations, and units for the results of implementation;
Only information, documents, and equipment of agencies, organizations, and units serving assigned tasks are allowed to be used; strictly prohibit the misuse, leakage, loss, copying or illegal transfer of classified documents, assets or assigned products;
Being guaranteed conditions to perform tasks (professional capacity, supporting human resources, necessary tools, means...) in accordance with the contract content and requirements of agencies, organizations, and units;
Being paid salaries, bonuses, remuneration, and lease regimes corresponding to the results and products according to the agreement in the contract and according to the provisions of law;
Being guaranteed working conditions according to the provisions of law, according to the regulations of agencies, organizations, units and according to agreements in contracts; having access to professional documents and necessary information to serve work according to the regulations of agencies, organizations, units;
The working time under labor contracts performing a number of professional and nghiep vu tasks specified in this Decree is calculated as a basis for salary ranking according to job positions if recruited and admitted to work as civil servants and public employees. Salary ranking corresponding to the job positions recruited and admitted shall be carried out in accordance with the provisions of law;
Be responsible for compensation for damages if breaches of contract obligations cause financial losses, property loss, product damage or leakage of confidential information and documents;
Comply with the provisions of law on protecting state secrets, internal regulations, rules, and professional regulations of agencies, organizations, and units.
Therefore, the Ministry of Home Affairs requested him to discuss with the contract management agency for consideration and resolution.
