Year-end bonuses for civil servants under Decree 73

The Ministry of Home Affairs clarifies the year-end bonus regime for civil servants according to Decree No. 73/2024/ND-CP.

Ms. Pham Thi Van (character name changed) said that in June 2025, the school where she worked had two civil servants transferred out of the area.

She proposed to clarify, according to the provisions of Decree No. 73/2024/ND-CP, how the year-end bonus regime for these civil servants will be paid: Is it calculated for 6 months in the old unit and 6 months in the new unit or is it entitled to bonuses for the whole year 2025 in the new unit.

Regarding the reflection and recommendations of Ms. Pham Thi Van, the Ministry of Home Affairs has responded on the Electronic Information Portal.

The Ministry of Home Affairs said that on June 30, 2024, the Government issued Decree No. 73/2024/ND-CP stipulating the base salary and bonus regime for cadres, civil servants, public employees and armed forces.

In which, Clause 1 and Clause 2, Article 4 of this Decree have stipulated the subjects implementing the bonus regime and assigned the heads of competent agencies to manage or be decentralized the authority to manage cadres, civil servants and heads of public non-business units to be responsible for developing specific Regulations to implement the bonus regime applied to subjects in the payroll of agencies and units.

The annual bonus fund specified in this Article is outside the commendation fund according to the provisions of the Law on Emulation and Commendation, which is determined to be equal to 10% of the total salary fund (excluding allowances) according to positions, titles, ranks, ranks and military ranks of subjects in the payroll of agencies and units.

By the end of January 31 of the following year, if agencies and units do not use up the bonus fund of the year, they are not allowed to transfer the source to the bonus fund of the following year.

The organization of policy implementation for cadres, civil servants, and public employees in Son La province is under the authority of the Chairman of the Provincial People's Committee.

Therefore, the Ministry of Home Affairs requests her to contact the agency managing officials, civil servants, and public employees of Son La province (Department of Home Affairs) for answers.
