Deputy Prime Minister Pham Thi Thanh Tra has just signed a decision promulgating Resolution No. 66.12/2026/NQ-CP of the Government on the organization and operation of the Military Commands of communes, wards, and special zones under the Military Command of provinces and centrally-run cities, the Hanoi Capital Command, and the Ho Chi Minh City Command.
The commune-level Military Command includes Commander, Political Commissar concurrently held by the Secretary of the commune-level Party Committee, Deputy Commander, Deputy Political Commissar, assistants and technical staff.
The Minister of National Defense decides on the organization, staffing, tasks and titles of the Commune-level Military Command, ensuring no increase in total staffing according to the decision of the competent authority.
This Resolution takes effect from January 26, 2026 to the end of February 28, 2027.
In the appendix to the list of legal documents to be amended and supplemented related to Resolution No. 66.12/2026/NQ-CP, the Government assigned the Ministry of National Defense in 2026 to propose the content of amending a number of regulations in Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of articles of the Law on Self-Defense Militia on organizing force building and policies for self-defense militia; Decree No. 16/2025/ND-CP dated February 4, 2025 amending and supplementing a number of articles of Decree No. 72/2020/ND-CP.
Including proposing the content of amending the number of Deputy Commanders of the Commune-level Military Command, Military Commands of agencies and organizations.
Amending the number of Deputy Commanders of the Commune-level Military Command, Military Commands of agencies and organizations in Article 4. Accordingly, the number of Deputy Commanders of the Commune-level Military Command is as follows:
Administrative units at commune level of type 1, border communes, coastal communes, and islands are arranged with no more than 2 Deputy Commanders.
Based on the actual situation, the provincial-level People's Committee submits to the People's Council of the same level to decide on the number of Deputy Commanders of the Commune-level Military Command in the number of non-specialized personnel at the commune level specified in Decree No. 34/2019/ND-CP dated April 24, 2019 of the Government amending and supplementing a number of regulations on commune-level officials and civil servants and non-specialized personnel at the commune level, in villages and residential groups;
Commune-level administrative units not subject to the above regulations shall appoint 1 Deputy Commander.
The Military Command of agencies and organizations arranges 1 Deputy Commander.
Based on the requirements of national defense, military tasks and the organization and operation of agencies and organizations, the Commander of the Hanoi Capital High Command, the Commander of the Ho Chi Minh City High Command, and the Commander of the Provincial Military Command shall consider and decide to appoint no more than 2 Deputy Commanders at the request of the head of the agency or organization.
Previously, Decree No. 220/2025/ND-CP dated August 7, 2025 stipulated the number of Deputy Commanders and assistants of the Commune-level Military Command as follows:
Key commune-level administrative units for national defense are arranged with no more than 2 Deputy Commanders and 1 assistant.
Administrative units at commune level that are not subject to the above-mentioned regulations shall arrange 1 Deputy Commander and 1 assistant.
