The Government has just issued Decree 200/2025/ND-CP dated July 9, 2025, detailing a number of articles of the Law on Civil Defense, which stipulates the functions, tasks and organizational structure of the Commune-level Civil Defense Command.
Regarding functions, the Commune-level Civil Defense Command is established by the Chairman of the Commune-level People's Committee, with the function of advising the Chairman of the People's Committee to organize, direct and manage civil defense in the management area.
The Commune-level Civil Defense Command has the following tasks:
Advising on the development and implementation of civil defense plans in the management area; advising and proposing the Chairman of the People's Committee at the commune level to issue a decision to announce and decide to abolish level 1 civil defense.
Organize and command forces and means of organizations and individuals in the area to participate in civil defense tasks.
Advising the Chairman of the People's Committee at the commune level to decide on urgent measures, mobilize resources according to authority, organize the reception and distribution of support and relief resources to carry out civil defense tasks in the management area.
Implement communication, notification, warning, and implementation of directives and regulations on prevention, response, and overcoming the consequences of incidents and disasters at all levels to the community.
Organize information, propaganda, education, and dissemination of knowledge about civil defense to organizations and individuals in the management area to improve the capacity to prevent, respond, and overcome the consequences of incidents and disasters.
Advising on inspections and urging organizations and individuals to perform civil defense tasks in the management area.
Regarding the organizational structure of the Commune-level Civil Defense Command, the Head of the Committee is the Chairman of the Commune-level People's Committee.
The Deputy Heads of the Committee include 1 Vice Chairman of the People's Committee at the commune level, the Standing Deputy Head of the Committee and 3 Deputy Heads of the Committee, the Commander of the Military Command, the Chief of the Commune-level Police and the Head of the Economic or Economic Department, Infrastructure and Urban Areas assigned to the task of state management of natural disaster prevention and control.
Members of the Commune-level Civil Defense Command shall be decided by the Chairman of the Commune-level People's Committee, including Heads of specialized departments not subject to the above-mentioned provisions.
Based on specific local conditions, the Chairman of the People's Committee at the commune level invited representatives of leaders of political organizations and unions at the commune level to join the Commune-level Civil Defense Command.
The agency assisting the Commune-level Civil Defense Command, the Commune-level People's Committee assigned to the Economic Department or the Economic, Infrastructure and Urban Area Department is assigned the task of state management of natural disaster prevention and control to preside over and coordinate the implementation of the task of advising the Commune-level Civil Defense Command on natural disaster prevention and control in the area and is granted funding to carry out the task.
Decree 200/2025/ND-CP takes effect from August 23, 2025.
