The Government has just issued Decree No. 129/2025 regulating the division of authority of local authorities at both levels in the field of state management of the Ministry of Home Affairs.
Decree 129/2025 stipulates the division of tasks and powers of local authorities at 2 levels (provincial and commune levels) when handling 75 procedures in the field of state management of the Ministry of Home Affairs; order and procedures for performing tasks and powers of local authorities at provincial and commune levels.
Notably, the Government clearly stipulates the authority to handle Association procedures in Article 59 of the Decree.
Accordingly, the Chairman of the People's Committee at the commune level has the authority to recognize the association mobilization committee; allow the establishment, division, separation, merger, consolidation, dissolution, renaming, and approval of the charter; temporarily suspend activities, and allow resumption of activities for associations operating within the commune according to regulations.
Documents and procedures for recognizing the association's establishment mobilization committee; allowing the establishment, division, separation, merger, consolidation, dissolution, renaming, and approval of charter; temporarily suspending activities, allowing the association to operate again within the commune to comply with the provisions of specialized laws.
In addition, the responsibility for state management of associations as prescribed in Article 50 of Decree No. 126/2024 implemented by the People's Committees at the commune level is also stated in the Decree as follows:
Management and inspection of compliance with the law on associations and the charter of associations operating within communes.
Inspect financial and assets activities, resolve complaints and denunciations, handle violations of assets, finance, and accounting for associations operating within the commune.
Reward or propose to competent authorities to reward associations, organizations, and individuals with achievements according to the provisions of law.
Resolve complaints and denunciations and handle violations related to administrative decisions and public service activities of cadres and civil servants in organizations under the People's Committee at the commune level according to the provisions of law.
Consider and decide to assign tasks to associations operating within communes in accordance with the Association's field of operation.
Every year, synthesize and report to the Provincial People's Committee on the organization, operation and management of associations operating within the commune.
Update the association database according to management decentralization and coordination in building, operating, and managing the association database within the commune.
The Chairman of the People's Committee at the commune level shall exercise his authority as prescribed in Clause 4, Article 15 of Decree No. 126/2024. Perform other tasks as prescribed by law.
