This content is stipulated in Decree No. 320/2026/ND-CP of the Government amending and supplementing a number of articles of Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government regulating electronic identification and authentication.
To create a legal corridor for integrating documents issued to businesses, organizations, and individuals into the electronic identification and authentication system, Decree No. 320/2026/ND-CP amends and supplements Article 8 as follows:
Article 8. Updating, sharing, and exploiting information and documents in the electronic identification and authentication system according to regulations.
1. Documents that are not state secrets issued by competent agencies and organizations to agencies, organizations, and individuals are automatically synchronized and updated into the electronic identification and authentication system when that agency or organization has a database that has been connected to the electronic identification and authentication system.
When information and documents on the National Identification Application (VNeID) change, the competent agency or organization issuing the document must immediately update the information and documents.
In case objectives cannot be implemented at the time of change, the update time on VNeID is no more than 24 hours from the time of data update and no more than 5 minutes in case citizens request a direct update on VNeID.
2. The integration of information and documents in cases where competent agencies and organizations issuing documents do not have a database is carried out as follows:
a) The electronic identity subject sends a request to integrate information and documents to the electronic identification and authentication system via VNeID;
b) Within 5 working days from the date the electronic identification and authentication system receives the request, the competent agency or organization issuing the document shall access the electronic identification and authentication system using the electronic identification account of that agency or organization to receive, process, and approve the request for integration of information and documents of the electronic identification subject according to the guidance of the Ministry of Public Security;
c) The competent agency or organization issuing the document shall update the information and documents integrated on VNeID simultaneously with the approval of the adjustment of that information and documents.
3. Agencies manage and operate electronic identification and authentication systems that integrate documents on VNeID at the request of electronic identity entities to serve sharing, exploitation, and use in the electronic environment.
4. State agencies, political organizations, socio-political organizations are allowed to exploit information and documents in the electronic identification and authentication system in accordance with the functions and tasks of those agencies and organizations.
5. Agencies, organizations, and individuals are allowed to exploit their information and documents in the electronic identification and authentication system.
6. Agencies, organizations, and individuals not subject to the provisions of Clauses 4 and 5 of this Article when exploiting information and documents of other organizations and individuals in the electronic identification and authentication system via VNeID must have the consent of the information and document subject being exploited.
In case of exploitation of information and documents of people who have lost civil act capacity, people who have difficulty in perceiving and controlling their actions according to the provisions of the Civil Code, people under 14 years old, people declared missing, and deceased people, the consent of one of the legal representatives or heirs according to the provisions of law is required.
