Continuing the 46th session of the National Assembly Standing Committee, on the afternoon of June 3, Minister of Home Affairs Pham Thi Thanh Tra presented a report on the reception, explanation, and revision of the draft Law on Organization of Local Government (amended).
Transferring many tasks and powers of the People's Committee to the Chairman of the People's Committee
According to Minister Pham Thi Thanh Tra, after receiving the opinions of National Assembly deputies, the Government has reviewed and revised to improve regulations on the tasks and powers of local authorities at the provincial and commune levels, ensuring comprehensive, complete and comprehensive regulations, as a legal basis for specialized laws specifically regulating tasks and powers in specialized fields.
At the same time, in order to enhance the role and responsibility of the heads according to the suggestions of the delegates, the Draft Law has completed the content of the assignment between the tasks and general powers of the People's Committee and the tasks and powers of the Chairman of the People's Committee in the direction of increasing more than the authority of the Chairman of the People's Committee.

Accordingly, the draft Law has transferred many tasks and powers of the People's Committee to the Chairman of the People's Committee to ensure quick and timely handling in directing and operating local administrative management activities.
The draft law stipulates that the People's Committee at the provincial level has 12 tasks and powers; the Chairman of the People's Committee at the provincial level has 23 tasks and powers.
Commune-level People's Committees have 10 tasks and powers; Chairmen of Commune-level People's Committees have 17 tasks and powers (previously 16.
In addition, in order to uphold the role and personal responsibility of the Chairman of the People's Committee, the Draft Law added that the Chairman of the People's Committee shall be on behalf of the People's Committee on behalf of the issues under the authority of the People's Committee and report it to the People's Committee at the last meeting (except for the contents that the Law stipulates that the People's Committee must discuss collectively and decide).
Hanoi fully organizes People's Councils and People's Committees until the end of the 2021 - 2026 term
The Hanoi National Assembly delegation, the Standing Committee of Hanoi City People's Council (People's Council) proposed to review and revise Article 53 of the Draft Law on local authorities in the ward of Hanoi City organized the People's Council and People's Committee in the term of 2021 - 2026 (different from the local authorities in Ho Chi Minh City and Da Nang City for the term 2021 - 2026 only organized the People's Committee by these wards under the urban government model).
Regarding this issue, the Government believes that local government in wards in Hanoi is organized according to a specific model (at the People's Councils of districts and towns under Hanoi, People's Councils are still organized).
Therefore, the Government believes that the proposal of Hanoi City is practical and can be implemented, contributing to solving the city's problems and difficulties, creating favorable conditions for the organization of local government in Hanoi City's wards to soon improve and stabilize the organization and staff, better ensure the right to represent the people...
On this basis, the Government proposed to revise the draft Law in the direction of removing the provisions on wards under Hanoi City in Article 53 of the draft law.
Accordingly, from July 1, 2025 (the time the Law on Organization of Local Government takes effect) until the end of the 2021 - 2026 term, local governments in wards under Hanoi will fully organize People's Councils and People's Committees.

However, with the reported data of Hanoi City, the number of key positions appointed by the Ward People's Council in special cases stated in Conclusion No. 150-KL/TW dated April 14, 2025 of the Politburo is very large (it is expected that 146 people in special cases who are not People's Council delegates will be appointed to hold the positions of Chairman, Vice Chairman, Head of the Ward People's Council).
Therefore, the Government believes that it is necessary to report to the Politburo for approval on this issue.
