On June 6, the National Assembly Standing Committee gave its opinion on the organization of the National Assembly Delegations and People's Councils (HDND) at all levels for the 2021-2026 term after the arrangement of administrative units.
One of the important contents of the guidance is the organization of People's Councils at the commune level.
Delegates of the People's Council at the commune level 2021-2026 at the post-arranged administrative units include: All representatives of the People's Council of the commune level of administrative units before arranging and representatives of the district People's Council (districts, towns and cities of provinces and cities in the city) for the term 2021-2026 have been elected in the administrative boundaries of administrative units of communes, wards and special zones.
Regarding the personnel of Chairmen, Vice Chairmen, and Heads of Committees of Commune People's Councils: Based on the announcement of competent Party committees on personnel management, the Standing Committee of the Provincial People's Council issued a resolution appointing Chairmen, Vice Chairmen, and Heads of Commune People's Councils after the arrangement.
In special cases, the Chairman and Vice Chairman of the People's Council at the commune level do not necessarily have to be a People's Council delegate.
At least 5 working days (calculated by post signs) from the date of the Resolution of the Standing Committee of the National Assembly on the arrangement of the commune -level administrative unit, the Commune Party Committee Standing Committee must send a written sent to the Standing Committee of the provincial People's Council on the list of personnel proposals to appoint personnel to hold the position of Chairman, Vice Chairman, Heads of the Committees of the commune People's Council.
No later than 5 days from the date of receipt of the proposal document of the Standing Committee of the Party Committee at the commune level, the Standing Committee of the Provincial People's Council shall issue a Resolution on personnel appointment.
Regarding personnel Deputy Head of the People's Council of the commune level, based on the notice of the competent authority on the management of cadres and standing of the People's Council at the commune level after arranging the resolution to approve the Deputy Head of the Committees of the People's Councils of the commune level.
The number of Deputy Heads of Commune People's Councils' Committees shall comply with the provisions of the Law on Organization of Local Government (amended).
In case the administrative unit after arranging the name of one of the administrative units (communes, wards and townships) before arranging, the Council's course in the new administrative unit continues to be calculated according to the lock of the People's Council in the administrative unit to keep the name.
In case the administrative unit after the arrangement of changing the name or changing the type of administrative unit (for example, from the commune into a ward), the People's Council's course in the new administrative unit has been recalculated from the beginning (Session I) from the time of establishment of a new administrative unit.
