The Government has just issued Decree No. 129/2025/ND-CP regulating the division of authority of local authorities at both levels in the field of state management of the Ministry of Home Affairs, effective from July 1.
Decree 129/2025 stipulates the division of tasks and powers of local authorities at 2 levels (provincial and commune levels) when handling 75 procedures in the field of state management of the Ministry of Home Affairs; order and procedures for performing tasks and powers of local authorities at provincial and commune levels.
In Decree No. 129, the Government clearly stipulates the division of authority when organizing a two-level local government in the field of meritorious people.
Notably, Article 4 of this Decree clearly states: The Head of the Commune-level Public Security Department shall issue a certificate to the victims who are officers, non-commissioned officers, soldiers, workers, and contract workers who do not have a fixed period of salary from the budget in the public security as prescribed in Point b, Clause 1, Article 17 of Decree No. 131/2021 dated December 30, 2021 of the Government detailing and measures to implement the Ordinance on Incentives for People with meritorious services to the Revolution.
The authority to issue a certificate of sacrifice prescribed in Clause 5, Article 16 of Decree No. 131/2021 shall be implemented as follows:
The victim is under the management of a district-level agency and is certified by the Chairman of the Provincial People's Committee.
The victim belongs to a commune-level agency and other cases (not a member of the armed forces, a person belonging to a central agency, or a provincial-level agency) are certified by the Chairman of the People's Committee at the commune level.
In the case of sacrificing people who are especially brave in saving people, protecting State and people's property or preventing and arresting people who commit crimes, it is an example of significance to honor, educate, and spread widely in society.
The issuance of a victim certificate must be based on the following documents: The record of the incident was made by the agency or unit directly managing the victim or the People's Committee of the commune where the incident occurred; for the purpose of preventing or arresting a person committing a crime, there must be a conclusion from the district-level investigation agency or higher. In particular, the arrest and storage of people who commit crimes must include a conclusion from an investigation agency at the provincial level or higher.
