The Government issued Decree No. 54/2026/ND-CP dated February 9, 2026, amending and supplementing a number of articles of Decrees in the field of housing and real estate business. Among them, noteworthy are regulations on social housing.
Regarding the conditions for enjoying social housing support policies, Decree No. 54/2026/ND-CP amends and supplements Clause 1, Article 29 of Decree No. 100/2024/ND-CP on housing conditions in the direction of expanding the criteria for determining conditions of not having housing, including cases where there is no housing information in the certificate and it does not depend on the time of submitting applications for buying or renting social housing.
At the same time, the authority to confirm is also regulated in a broader direction, which is to assign it to the competent authority to issue Certificates according to land law.
In case there is no housing owned by them, it is determined when the subject specified in Clause 1, Article 77 of the Housing Law and the spouse of that subject (if any) are determined to have no name or no housing information content in the certificate of land use rights, ownership of assets attached to land in the province or centrally-run city where that social housing project is located.
Within 7 days from the date of receiving the request for confirmation of housing conditions, the competent authority issuing the certificate of land use rights, ownership of assets attached to land according to the provisions of land law in the province or centrally-run city where there is a social housing project certified according to the provisions of this clause".
Decree No. 54/2026/ND-CP amends and supplements Clause 2, Article 30 of Decree No. 100/2024/ND-CP on income conditions to enjoy social housing policies in the direction of transferring the authority to confirm from the commune-level People's Committee to the commune-level Police and supplementing the mechanism for declaration, commitment, and income post-inspection.
The new regulations also clearly define the request for confirmation as a document proving the beneficiaries of social housing policies.
In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a labor contract, it must ensure income conditions according to the above regulations and be certified by the commune-level police agency at the place of permanent or temporary residence or current residence.
Within 7 days from the date of receiving the request for confirmation, the commune-level police where the citizen is permanently residing or temporarily residing or the current residence at the time the citizen requests, are responsible for confirming information including: Full name, middle name and name; Date, month, year of birth; gender; personal identification number; date, month, year of issuance of ID card/citizen identification card; permanent residence/temporary residence/current residence.
Citizens are responsible for declaring and committing to information on average monthly income. Commune-level police coordinate with relevant agencies in verifying and post-checking information on average monthly income of citizens for necessary cases.
The application form confirming the income conditions specified in this clause is also a document proving the beneficiaries of social housing support policies.
