The National Assembly Standing Committee has requested the Ministry of Home Affairs and the National Assembly's Law and Justice Committee to continue to closely coordinate to complete the dossier of the draft Law on Cadres and Civil Servants (amended) to submit to the National Assembly at the upcoming 9th Session.
According to the Government's Submission, the draft Law on amending consists of 7 Chapters and 52 Articles (a reduction of 35 Articles compared to the current Law).
Minister of Home Affairs Pham Thi Thanh Tra said that the draft Law amends and supplements regulations on the mechanism for management and use of cadres and civil servants in a transparent and effective manner, in line with the requirements of administrative reform.
Accordingly, the method of managing cadres and civil servants will be converted according to job positions. Specifically, it is stipulated that the assessment, arrangement and use of cadres and civil servants must be based on the requirements of the job position and the capacity, results and effectiveness of the performance of the tasks of cadres and civil servants.
Remove the regulation on promotion exams, instead, there is a mechanism for appointing to the rank corresponding to the requirements of the assigned job position according to capacity and performance results.

At the 44th session of the National Assembly Standing Committee, Permanent Deputy Chairman of the Economic and Financial Committee Le Quang Manh said that the draft Law adds many new policies on management and use of cadres and civil servants.
Among them, there are many policies that require the use of the state budget such as: salary reform according to job position, talent promotion, incentives for civil servants working in extremely difficult areas, and funding to resolve the regime for commune-level civil servants after the arrangement.

In order for these policies to be put into practice, Mr. Le Quang Manh suggested that the drafting agency should have a specific assessment of the impact of implementing the above policies on the state budget every year, for a 5-year period, to avoid creating passiveness for the budget in the context that from 2026-2030 it is necessary to allocate large amounts of money for many different fields.
Mr. Le Quang Manh also said that Clause 1, Article 11 stipulates that cadres and civil servants "are entitled to salary, bonus and other income according to the results, products, and work efficiency of the job position, in accordance with the socio-economic conditions of the country".
However, Article 43 of the draft Law stipulates that salary reduction is a form of discipline for civil servants who do not hold leadership or management positions.
The Standing Vice Chairman of the Economic and Financial Committee suggested that the drafting agency should review to ensure the consistency of the draft Law when designed on a completely new mindset.
