The Ministry of Home Affairs proposes that civil servants subject to staff streamlining will enjoy 3 regimes if they quit their jobs right in the draft Decree that has just been finalized.

Authorized by the Minister of Home Affairs, Deputy Minister of Home Affairs Vu Chien Thang signed a Report on the draft Decree to replace Decree No. 29/2023 dated March 6, 2023 of the Government regulating staff streamlining to the Ministry of Justice for appraisal.

The draft Decree was developed on the basis of inheriting Decree No. 29/2023 and has amended and supplemented a number of contents.

In the Draft Submission, the Ministry of Home Affairs stated that the staff streamlining policy in Decree No. 108/2014, Decree No. 113/2018, and Decree No. 143/2020 stipulate the termination policy applied to those who have reached the retirement age of 2 years or more and are not eligible for early retirement.

Accordingly, those who are 2 years old or younger to retirement age and have not paid enough compulsory social insurance to retire are not eligible for severance pay.

However, in the process of implementing the policy, the Ministry of Home Affairs has received a number of opinions from ministries, branches and localities proposing to supplement policies for these subjects.

Therefore, to ensure their rights, the Ministry of Home Affairs has proposed to add subjects of staff streamlining aged 2 years or younger to retirement age and who have not paid enough compulsory social insurance to retire to enjoy the immediate severance pay policy.

Accordingly, subjects who are subject to staff reduction and have not reached the retirement age as prescribed in Appendix I and Appendix II issued with Decree No. 135/2020 and are not eligible for the early retirement policy prescribed in Article 6 of this Decree, if they quit their jobs immediately, will enjoy the following benefits:

First, receive a subsidy of 3 months of current salary to find a job;

Second, receive a subsidy of 1.5 months of current salary for each year of work with compulsory social insurance contributions;

Third, reserve the period of compulsory social insurance payment or receive one-time social insurance according to the provisions of the law on social insurance.
