The Ministry of Home Affairs is seeking opinions on a draft Decree guiding the collection of public opinions on the establishment, dissolution, merger, division, adjustment of boundaries and renaming of administrative units.
In the draft Decree, the Ministry of Home Affairs proposes that People's Committees at all levels organize propaganda and disseminate publicly on collecting public opinions on the establishment, disolution, merger, division, adjustment of boundaries and renaming of administrative units in accordance with the practical situation of the locality and the provisions of law on implementing democracy at the grassroots level.
Documents for collecting opinions on the project to establish, dissolve, merge, divide, adjust boundaries and rename administrative units.
Along with that is a summary of the project, including the following contents: Plan to establish, dissolve, merge, divide, adjust boundaries and rename administrative units; summary assessment of standards of administrative units (if any) and conditions for establishing, dissolving, merging, dividing, adjusting boundaries and renaming administrative units; list of policy and orientation documents of the Party and State.
This document must be posted on the Electronic Information Portal or the electronic information page of the People's Committee at the provincial and commune levels (if any).
The materials for collecting opinions are also listed at the headquarters of the People's Committee at the commune level, community activity points and are disseminated and disseminated on local mass media, at village and residential group meetings during the time of collecting people's opinions.
Regarding the reception and handling of recommendations on the results of public consultation, the draft states that when detecting errors, citizens and organizations have the right to complain to the People's Committee where the results of public consultation are reported.
If the reclamant does not agree with the results of the complaint settlement or the complaint settlement deadline has expired and the complaint is not resolved, he/she has the right to file a lawsuit at the People's Court according to the provisions of the law on administrative proceedings.
The Ministry of Home Affairs inspects and guides People's Committees at all levels in collecting public opinions on the project of establishing, dissolving, merging, dividing, adjusting boundaries and renaming administrative units in specific cases.
The Provincial People's Committee is responsible for organizing the collection of public opinions on the policy of establishing, dissolving, merging, dividing, adjusting boundaries and renaming administrative units.
This level also guides, inspects, allocates funding and ensures necessary conditions for the People's Committees at the commune level in collecting public opinions according to the provisions of this draft Decree and assigning them to the People's Committees at the provincial level.
