In the draft Decree guiding the collection of public opinions on the establishment, dissolution, merger, division, adjustment of boundaries and renaming of administrative units, the Ministry of Home Affairs proposes that in case of establishment, dissolution, merger, division, adjustment of boundaries and renaming of provincial-level administrative units, the Provincial People's Committee will organize a collection of household opinions in all commune-level administrative units under that provincial-level administrative unit.
At the same time, if the boundary is established, dissolved, merged, divided, and the name of the commune-level administrative unit is changed, the provincial People's Committee will organize a consultation with the household in that commune-level administrative unit.
The People's Committee of the commune organizes the collection of public opinions by distributing Household opinions Fills according to the prescribed form.
The commune level will organize the distribution of votes to each household in forms suitable to the specific conditions of the locality, ensuring the provisions of the law on implementing democracy at the grassroots level.
After the process of collecting opinions, the report on the results of the public consultation must show the total number of households in the area, the number of households participating in the consultation, the number of households agreeing, the number of households disagreeing, and other opinions (if any).
The Ministry of Home Affairs proposed that if the results of the consultation reached over 50% of the total number of households in the area (calculated for each commune-level administrative unit) in favor, the project development agency should continue to complete the project and send it to the People's Councils of relevant administrative units for consultation.
In case it is not reached 50%, the Provincial People's Committee will direct the organization of propaganda, persuasion, mobilization and acceptance of the people's valid opinions to complete the Project, ensuring the people's approval rate according to regulations.
In particular, the draft decree also states that the results of public consultation must be made public on local information pages and portals and on the Government's Electronic Information Portal.
When detecting errors in the results of the public consultation, citizens and organizations have the right to complain to the People's Committee where the consultation report is prepared. Within 5 working days from the date of receipt of the complaint, the People's Committee must resolve the complaint and notify the complainant of the results of the settlement.
In addition, in case errors in the results of the consultation are detected due to the process of synthesizing and preparing reports, the People's Committees at all levels will revise and complete the report on the results of the consultation of the people to competent authorities according to the provisions of the Law on Organization of Local Government and this draft decree.
