On the morning of June 16, the 9th Session of the 15th National Assembly passed the Law on Organization of Local Government (amended) with 100% of National Assembly deputies present voting in favor.
The Law clearly stipulates that the People's Council (PC) operates under a collective regime, decided by majority.
The People's Council consists of People's Council delegates elected by local voters, which are local state power agencies, representing the will, aspirations and mastery of the people, deciding on important local issues.
The People's Council supervises compliance with the Constitution and laws, supervises the activities of local state agencies; is responsible to the local people and higher-level state agencies.
People's Council delegates are the representatives of the will and aspirations of the local people, responsible to local voters and the People's Council for the implementation of their duties and powers as delegates.
People's Council delegates must meet the following standards:
First, be loyal to the Fatherland, the people and the Constitution, strive to carry out the renovation process, for the goal of a rich people, a strong country, democracy, fairness and civilization.
Second, there is only one nationality which is Vietnamese nationality.
Third, have good moral qualities, be cautious, thrifty, honest, upright, impartial, carefree, exemplary in complying with the law; have courage, resolutely fight against corruption, negativity, waste, all manifestations of bureaucracy, extortion, embezzlement of rights and other violations of the law.
Fourth, have educational and professional qualifications, sufficient capacity, health, work experience and prestige to perform delegate duties; have the conditions to participate in People's Council activities.
Fifth, residing or working at an agency, organization, unit, or enterprise in an administrative unit where they are a People's Council delegate.
Sixth, closely contact the people, listen to the people's opinions, and be trusted by the people.
The term of each term of the People's Council is 5 years from the opening date of the first session of the People's Council of that term to the opening date of the first session of the new term of the People's Council. The shortening or extension of the term of the People's Council is decided by the National Assembly at the request of the National Assembly Standing Committee.
The National Assembly Standing Committee supervises and guides the activities of the People's Council; promulgates exemplary working regulations of the People's Council. The Government guides and inspects the People's Councils in implementing documents of superior state agencies; creates conditions for the People's Councils to perform their duties and powers according to the law.
This Law takes effect from the date of promulgation.
