On the morning of June 16, with 466/466 delegates participating in the vote, the National Assembly passed the Law on Organization of Local Government (amended).
Reporting on the acceptance of the draft law, Minister of Home Affairs Pham Thi Thanh Tra said that, accepting the opinions of National Assembly deputies, the Government has revised and supplemented the regulations on the determination of authority, decentralization, delegation and delegation of authority.
In particular, adding decentralization subjects such as People's Councils and Chairmen of Provincial People's Committees; adding monitoring, evaluation and supervision mechanisms to promptly adjust the contents of decentralization and delegation.
The Chairman of the Provincial People's Committee is authorized to directly direct and manage the settlement of issues under the tasks and powers of other specialized agencies and administrative organizations under his or her authority and the Chairman of the People's Committee and the Chairman of the People's Committee at the commune level, not to let the settlement of work and administrative procedures for people and businesses stagnate, congest, or be ineffective.
Based on the principles of determining authority, the law has comprehensively redraw the tasks and powers of local authorities at both levels (provincial and commune levels), ensuring a clear understanding, without overlapping or overlapping tasks and powers of each level.
Create a legal basis for specialized laws to base on the provisions of this Law to specifically stipulate the tasks and powers of local authorities at the provincial and commune levels in specialized fields.
Accordingly, some tasks and powers of the People's Committee are adjusted to the Chairman of the People's Committee (the Provincial People's Committee has 12 groups of tasks and powers; the Chairman of the Provincial People's Committee has 23 groups of tasks and powers; the Commune People's Committee has 10 groups of tasks and powers; the Chairman of the Commune People's Committee has 17 groups of tasks and powers).
Supplementing the regulation that the Chairman of the People's Committee is allowed to decide on the duties and powers of the People's Committee (except for the contents that must be discussed collectively by the People's Committee) and report to the People's Committee at the most recent People's Committee meeting.
"This is a strong reform step to enhance the responsibility of leaders, creating motivation for innovation in local governance," the Minister stated.
According to the Minister, these provisions of the Law will ensure the promotion of initiative, creativity, flexibility, enhance the responsibility of the Chairman of the People's Committee, and the effectiveness and efficiency of state administrative management and operation in localities in accordance with practical requirements.
The law stipulates that the People's Council at the commune level has 2 Committees: the Economic - Budget Committee and the Cultural - Social Committee. Maintain the number of People's Council delegates at the provincial and commune levels within the minimum and maximum framework (the number of People's Council delegates of Ho Chi Minh City and Hanoi City alone has 125 delegates).
The regulation is principle in the law "Chairman, Vice Chairman, Head of the Committee, Deputy Head of the Committee of the People's Council at the provincial and commune levels, members of the Committee of the People's Council at the provincial level can be full-time People's Council delegates".
Assign the "National Assembly Standing Committee to specify the number of Vice Chairmen and Deputy Heads of Committees of People's Councils at the provincial and commune levels, and the arrangement of People's Council delegates at the provincial and commune levels to work full-time".
This is to ensure flexibility, in accordance with the reality of the country and the locality according to each stage of the country's development or when there are new policies and orientations from competent authorities, it is not necessary to amend or supplement these provisions of the law.
The law stipulates the transition for wards of Hanoi, Ho Chi Minh City and Da Nang to implement the urban government model (currently only organizing People's Committees, not organizing People's Councils) to the local government organization model (with full People's Councils and People's Committees) to be operated smoothly and effectively from July 1, 2025.
