In the draft Decree being developed, the Ministry of Home Affairs proposes 9 groups of subjects to receive as civil servants.

The Ministry of Home Affairs is seeking opinions on the draft Decree regulating the recruitment, use and management of public employees to replace Decree No. 115/2020/ND-CP (amended and supplemented in Decree No. 85/2023/ND-CP).

Notably, regarding the recruitment of civil servants, the Ministry of Home Affairs said that the regulations on receiving civil servants for commune-level cadres and civil servants are not appropriate because the Law on Cadres and Civil Servants No. 80/2025/QH15 no longer includes this subject.

Compared to the regulations in the current Decree, the draft Decree has omitted: The entire content of regulations on probation; Regulations on the use of input quality accreditation results for civil servants when completing recruitment dossiers or when taking the first round of civil servant recruitment; Subjects admitted to civil servant positions are commune-level cadres and civil servants;

Removing the mandatory foreign language exam regulation in Round 1, accordingly, assigning the recruiting authority to decide to organize the exam in cases where the job position requires foreign languages; The form of organizing the professional subject exam (Round 2) includes practice or a combination of writing and interview.

In the draft Decree, the Ministry of Home Affairs proposes that the subjects to be recruited as public employees include:

First, experts, scientists, jurists, good lawyers, typical and outstanding entrepreneurs working in agencies, organizations, and units outside the public sector according to the policy of attracting talented people;

Second, people with 5 years or more of service who are doing professional and nghiệp vụ work suitable to the job position expected to be received at agencies, organizations, and units established in accordance with the law.

The working time at this point is the time working in professional and nghiệp vụ work that requires a training level suitable for the job at the expected job position according to the provisions of law, with compulsory social insurance contributions; In case there is non-continuous working time but no one-time social insurance allowance has been received, it will be accumulated.

Third, people who used to be cadres, civil servants, public employees, and then were decided by competent authorities in writing to transfer to work at other agencies, organizations, and units but still do work in accordance with the expected job position to be received;

Fourth, people with a doctorate degree or higher (recognized by competent authorities according to regulations) working at agencies or organizations with headquarters or branches established abroad or at foreign agencies or organizations with headquarters or branches established in Vietnam, with training majors suitable for the job position to be recruited and having 03 years or more of professional work suitable for the job position expected to be received;

Fifth, people with special talents and abilities suitable for job positions in the fields of culture, art, sports, traditional occupations according to the provisions of specialized laws and on industries and fields;

Sixth, people who are signing contracts to work at public non-business units;

Seventh, Team members of the Pilot Project on selecting young intellectuals to volunteer to communes to participate in rural and mountainous development in the period 2013 - 2020 who are signing labor contracts to work in communes;

Eighth, non-specialized commune-level personnel before July 1, 2025.

Finally, other subjects according to the provisions of law on industry and field.
