The Ministry of Home Affairs has reported on the progress of preparation and some major contents of the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH).
In which, the Ministry of Home Affairs has proposed to abolish some contents on administrative procedure dossiers, abolish regulations on unemployment insurance (BHTN), health insurance (BHYT).
The report clearly states that the regulation of administrative procedures and dossier components in the current Law causes difficulties in the process of simplifying administrative procedures for people, beneficiaries, and businesses in the process of participating in and resolving social insurance regimes.
To ensure compliance with the authority to promulgate and the content of the draft Law according to the provisions of the Law on Organization of the National Assembly, the Law on Promulgation of Legal Documents and to implement tasks and solutions on digital transformation, maximizing the simplification of administrative procedures in the field of social insurance to create favorable conditions for people and businesses; the draft Law abolishes regulations on dossiers and procedures on social insurance in the Law on Social Insurance; instead, assigning the Government to regulate dossiers and procedures for participation, proposing to resolve regimes.
Another issue is that currently the functions, powers and responsibilities of the social insurance agency regarding health insurance and unemployment insurance, management and use of the unemployment insurance and health insurance funds have been stipulated in the Law on Health Insurance, the Law on Employment and Decree No. 374/ND-CP.
Therefore, to ensure uniformity and synchronization in the legal system, the draft Law abolishes regulations on the functions, powers and responsibilities of social insurance agencies regarding unemployment insurance, health insurance and management and use of unemployment insurance and health insurance funds.
The draft law also does not specifically stipulate the specialized inspection authority of ministries and social insurance agencies to be consistent with the provisions of the law on inspection.
