According to the Government's electronic information portal, the Ministry of National Defense recently received a petition from voters in Hung Yen province regarding: "Proposal to study and submit to the National Assembly a supplement to the Law on Military Service requiring citizens of military age who pass the entrance exam to schools to reserve their results but must complete their military service and then return to continue their studies."
Regarding this content, the Ministry of National Defense said that, according to the provisions of Point g, Clause 1, Article 41 of the Law on Military Service 2015, for citizens: "Studying at a general education institution; being trained at a full-time university level at a university education institution, or at a full-time college level at a vocational education institution during a training course of a training level" will be temporarily deferred from military service.
On the other hand, to ensure social justice, the age of active military service of citizens subject to the above-mentioned deferment is also extended so that citizens have the opportunity to fulfill their sacred duty to the Fatherland. Therefore, Article 30 of the Law stipulates that “Citizens who are 18 years old are called up for military service; the age of military service is from 18 to 25 years old; citizens who have received college or university degrees and have been deferred from military service, the age of military service is up to 27 years old”.
At the same time, Point b Clause 3 Article 50 of the Law stipulates the regime and policies for non-commissioned officers, soldiers serving in the army, discharged from the army and their relatives: "Before joining the army, those who were studying or received a call to study at schools belonging to vocational education institutions or universities will have their results reserved and be accepted to study at those schools".
Thus, the above provisions of the Law have contributed to ensuring fairness in the performance of military service, while meeting the legitimate aspirations of citizens' rights and legal interests to study and work in accordance with the provisions of law; at the same time, creating a high-quality human resource necessary for the cause of industrialization and modernization of the country, while ensuring sufficient quantity and quality of citizens joining the army.
The Ministry of National Defense said that, according to voters' recommendations, the requirement that all citizens of military age who pass the entrance exams to schools have their results reserved but must complete military service and then return to continue studying in the current period needs to be studied comprehensively, fully and thoroughly.
The Ministry of National Defence will continue to conduct comprehensive research, fully assess related policies and impacts, report and propose to the Government to amend and supplement the 2015 Law on Military Service at the appropriate time when there is a full political, legal, practical basis, ensuring scientific and feasible assurance so that the law on military service is implemented effectively, practically and strictly.
