The Ministry of Justice is reviewing the draft Decree regulating the framework for the number of Vice Chairmen of the People's Committee, the number and structure of People's Committee members; the order and procedures for approving the results of the People's Council in electing, dismissing, and removing Chairmen and Vice Chairmen of the People's Committee; the order and procedures for transferring, removing Chairmen and Vice Chairmen of the People's Committee and assigning the authority to Chairmen of People's Committees at all levels. The Ministry of Home Affairs chaired the draft.
The draft decree provides for 1 article regulating the number of Vice Chairmen of Commune People's Committees.
Accordingly, the number of Vice Chairmen of Commune People's Committees is calculated on the average principle of no more than 2.5 Vice Chairmen of Commune People's Committees for each commune-level administrative unit.
Based on the total number of Vice Chairmen of Commune People's Committees of the whole province and city calculated according to the principle prescribed in Clause 1 of this Article, the Chairman of the Provincial People's Committee shall specifically decide on the number of Vice Chairmen of Commune People's Committees of each commune level in accordance with the natural area, population size, classification of administrative units, socio-economic development level and practical situation of the locality, but must ensure that it does not exceed the total number of Vice Chairmen of Commune People's Commune People's Committees of the whole province and city.
For special areas with a permanent population of less than 1,000 people, the Government's regulations on the duties, powers, organization and operation of the People's Committee, Chairman of the People's Committee, specialized agencies, and other administrative organizations under the People's Committee of the special zone shall apply in special cases.
The draft decree also stipulates the number and structure of members of the People's Committee at the provincial and commune levels.
Members of the People's Committees at the provincial and commune levels include heads of specialized agencies under the People's Committees at the provincial and commune levels; members in charge of military affairs and members in charge of public security.
Number and specific titles of members of the People's Committees at the provincial and commune levels who are heads of specialized agencies under the People's Committees at the provincial and commune levels shall comply with the Government's regulations on the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes, wards and special zones.
