The Ministry of National Defense is seeking opinions on the draft Decree amending and supplementing a number of articles of the Government's Decrees on the division of authority in the fields of national defense, military, command of the People's Army, and militia when organizing local government at 2 levels.
In this draft, the Ministry of Defense proposes to amend and supplement a number of articles of the Government's Decree No. 72/2020/ND-CP of June 30, 2020, detailing a number of articles of the Law on Militia and Self-Self-Defense Organization on the organization of building force and policies and policies for militia and self-defense militia, amendments and supplements to a number of articles in Decree No. 16/2025/ND-CP dated 4.2225 of the Government.
The Ministry of National Defense accordingly proposed to amend and supplement Article 10 to: "Seniority allowance regime for command and assistant positions of the Commune-level Military Command".
At the same time, amend Clause 1, Article 10 to: Commander, Political Commissar, Deputy Commander, Deputy Political Commissar, Assistant to the Commune-level Military Command with a working period of 60 months or more to receive seniority allowances.
The allowance level is as follows: After 5 years (fully 60 months) of work, seniority allowance is equal to 5% of current salary and position allowance, seniority allowance exceeding the framework (if any) or current monthly allowance; from the 6th year onwards, each year (fully 12 months) is calculated by 1%.
According to the proposed amendment in Clause 2, Article 10: Commanders, Political Commissars, Deputy Commanders, Deputy Political Commissars, and assistants of Commune-level Military Commands who have worked in other professions and are entitled to seniority allowances will be added to the time holding the positions of Commanders of Commune-level Military Commands to calculate seniority allowances.
The seniority allowance calculation period prescribed in Clause 1 of this Article, if there is a gap, will be accumulated.
The draft of the Ministry of National Defense also amends Clause 3, Article 10 of Decree No. 72/2020/ND-CP (amended in Clause 3, Article 1 of Decree No. 16/2025/ND-CP) in the direction of:
- The seniority allowance regime for Commanders, Political Commissars, Deputy Commanders, Deputy Political Commissars, and assistants of the Commune-level Military Command is calculated at the same salary and monthly allowance.
- Seniority allowances for Commanders, Deputy Commanders, and assistants of Commune-level Military Commands are calculated for social insurance and health insurance contributions and benefits.
