The Ministry of National Defense is seeking opinions on the draft Decree amending and supplementing a number of articles of the Government's Decrees on the division of authority in the fields of national defense, military, command of the People's Army, and militia when organizing local government at 2 levels.
In this draft, the Ministry of Defense proposes to amend and supplement a number of articles of the Government's Decree No. 72/2020/ND-CP of June 30, 2020, detailing a number of articles of the Law on Militia and Self-Self-Defense Organization on the organization of building force and policies and policies for militia and self-defense militia, amendments and supplements to a number of articles in Decree No. 16/2025/ND-CP dated 4.2225 of the Government.
In particular, it is proposed to amend and supplement Clause 1, Article 4 of the number of Deputy Commanders and assistants of the Commune-level Military Command as follows:
- For key commune-level administrative units in defense, 2 Deputy Commanders and 1 assistant are assigned.
- Commune-level administrative units not falling under the above cases shall arrange 1 Deputy Commander and 1 assistant.
Previously, according to Clause 3, Article 3 of Decree No. 72/2020/ND-CP, the Commune-level Military Command, the Military Command of agencies, organizations, and commands self-defense units where there is no Military Command of agencies and organizations to manage:
a) The militia unit at its level;
b) Militia and Self-Defense Units organized by superiors, except for training and operation time.
The draft Decree adds point c after point b, clause 3, Article 3 of Decree No. 72/2020/ND-CP as follows:
The Commune-level Military Command manages the Military Command of an agency or organization not falling under the provisions of Point a, Clause 1, Article 3 of Decree No. 72/2020/ND-CP.
Also according to Article 3 of Decree No. 72/2020/ND-CP, Hanoi Capital Command, Ho Chi Minh City Command, Provincial Military Command: Military Command of agencies and organizations under enterprises with self-defense battalions; Military Command of agencies and organizations under departments, branches, sectors and equivalents at the provincial level, management board of industrial parks, export processing zones, high-tech zones, economic zones in the area.
