The Ministry of Justice is reviewing the draft Decree regulating the framework for the number of Vice Chairmen of the People's Committee, the number and structure of People's Committee members; the order and procedures for approving the results of the People's Council in electing, dismissing, and removing Chairmen and Vice Chairmen of the People's Committee; the order and procedures for transferring, removing Chairmen and Vice Chairmen of the People's Committee and assigning the authority to Chairmen of People's Committees at all levels. The Ministry of Home Affairs chaired the draft.
Article 3 of the draft stipulates the authority to approve the results of the election, dismissal, and removal of Chairmen and Vice Chairmen of the People's Committee to decide on the transfer and removal of Chairmen and Vice Chairmen of the People's Committee and the authority of the Chairman of the People's Committee.
Accordingly, the Prime Minister approved the results of the election, dismissal, and removal of Chairman and Vice Chairman of the Provincial People's Committee; decided to transfer and remove the Chairman and Vice Chairman of the Provincial People's Committee and assigned the authority of the Chairman of the Provincial People's Committee.

The Ministry of Home Affairs said that the above proposal has removed regulations related to district level to suit the 2-level local government model.
According to current regulations, the Chairman of the District People's Committee approves the results of the election, dismissal, and removal of Chairman and Vice Chairman of the Commune People's Committee; decides on the transfer and removal of Chairman and Vice Chairman of the Commune People's Committee and assigns the authority of the Chairman of the Commune People's Committee.
The draft decree also stipulates that the average number of Vice Chairmen of Commune-level People's Committees does not exceed 2.5 people/administrative unit, calculated for the whole province and city.
Based on the total allocated, the Chairman of the Provincial People's Committee shall specifically decide on the number of Vice Chairmen of each commune level in accordance with the population size, area, classification of administrative units, socio-economic conditions and characteristics of the region and region, but not exceeding the assigned total.
In addition, special areas with a permanent population of less than 1,000 people are implemented according to separate regulations of the Government.
