The Ministry of Home Affairs is seeking opinions on the draft Decree of the Government on regulating the salary, remuneration, and bonus regime for representatives of direct owners, representatives of state capital, and controllers in state-owned enterprises.
Regarding salary levels, the draft stipulates that Council members and Inspectorates are entitled to basic salary and additional salary according to production and business efficiency, decided by the enterprise after consulting with the owner.
The basic salary is determined based on the capital, revenue, and profit indicators, including 7 salary levels and divided into 2 groups, including: group I has 4 levels, applied to corporations and economic groups; group II has 3 levels applied to independent enterprises.

The highest rate for a chairman (level 1 group I) is 80 million VND and the lowest for a board member or controller (level 3 group II) is 30 million VND/month, according to the provisions of Decree No. 44.
In case a state-owned enterprise has a profit lower than the plan, the maximum salary will be calculated at 90% (instead of 70% as currently regulated under Decree No. 44), multiplied by 2 times the basic salary, multiplied by the rate of realized profit compared to the profit according to the plan. The salary after calculation is not lower than 80% of the basic salary.
In case the enterprise is profitable, the maximum salary is calculated at 2 times the basic salary; the enterprise is not profitable, the maximum is 70% of the basic salary; the enterprise loses, the maximum is 50%.
In case the enterprise loses (including no profits), the level of loss reduction compared to the plan will be used to determine the salary level, up to 80% of the basic salary.
Enterprises with large scale, with higher profits than minimum profits (banking, telecommunications, oil and gas sector is VND 5,500 billion), holding an important position in the economy but having lower salaries than equivalent positions in the market, shall follow the framework proposed in the draft.
For enterprises with actual profits twice the minimum level, the salary received will be increased by 2.5 times the basic level (maximum 200 million VND/month); the profit received will be 3 times higher than the basic level (maximum 240 million VND/month); the profit received will be 5 times higher than the basic level (maximum 320 million VND/month).
For newly established or newly operated enterprises, the maximum salary in the first year of establishment or newly operated must not exceed the basic salary.
Newly established enterprises on the basis of merging enterprises, if the salary is lower than the actual salary at the highest level of the corresponding positions of member enterprises before the merger, it will be calculated at the salary level of those corresponding positions.
Enterprises that only carry out public products and services are allowed to use the volume indicator of public products and services to evaluate and determine the salary level.
Enterprises that have both implemented public products and services and also operated production and business (in addition to implementing public products and services) can choose to determine the salary level according to production and business activities according to regulations.
The salary level of council members and inspectors who are officers, professional soldiers, defense officials, officers, non-commissioned officers, and people working in secret services shall not be lower than the salary level according to the position, title, rank, rank, level, and salary allowances as prescribed by the Government.
The remuneration level of non-professional council members and inspectors is determined based on actual working time, but not exceeding 20% of the corresponding salary of the council members and full-time inspectors.
