Continuing the 9th Session, on the morning of May 6, the National Assembly listened to the Submission and Report on the review of the draft Law amending and supplementing a number of articles of the Law on Product and Goods Quality.

Presenting the Proposal, Deputy Prime Minister Le Thanh Long stated the practical basis for implementing the Law on Product and Goods Quality. According to the assessment, the summary process after 17 years of implementation shows that, in addition to the achieved results, the Law on Product and Commodity Quality 2007 has arisen a number of shortcomings and limitations, requiring amendments to suit reality and promote development.
The draft revised law is built on the basis of "4 viewpoints and 4 policies" approved by the Government in Resolution No. 203/2023. The draft law amends and supplements 30 Articles, adds 17 Articles, and abolishes 34 Articles out of a total of 7 Chapters and 72 Articles of the Law on Product and Goods Quality.
In particular, the amendment and supplementation revolve around basic contents, such as determining the Law on Product and Commodity Quality and the framework law, specialized laws have detailed regulations but not contrary to general principles. Abandoning the concepts such as group 1, group 2 and replacing them with classification according to 3 levels of risk: low, medium and high, in accordance with international practice.
Supplementing regulations on the development of national quality infrastructure, improving capacity in standards, measurement, testing, certification and recognition, serving management, promoting innovation and creativity, and enhancing the competitiveness of Vietnamese goods.

The draft law also mentioned the need to more strictly manage the quality of products and goods in e-commerce.
practice shows that e-commerce business is growing rapidly and accounts for a large proportion of goods trading in general. Online sales do not require a warehouse to store goods, the source of goods can be taken from many different places, making it difficult to check, control, and supervise subjects.
"The draft law clearly stipulates the responsibilities of e-commerce platforms and sellers in transparently displaying traceability information. E-commerce platforms must take full responsibility if they allow poor quality goods to occur," Deputy Prime Minister Le Thanh Long explained.
In addition, the draft law proposes to strengthen the handling of violations of product quality. Increase administrative fines, publicize organizations and individuals who violate. Apply strong measures such as suspending operations, revoking products, revoking licenses, and prosecuting criminal liability if necessary.

Presentation of the above -mentioned law verification report, Chairman of the National Assembly's Committee for Science, Technology and Environment (Science, Technology and Environment) of the National Assembly Le Quang Huy said that the Committee of Science and Technology and Environment is basically unified with the viewpoint of the law project and proposes to continue studying a number of issues to complete the draft law, such as: Principle of product quality management (CLSPHH) at the level of risk level;
Applying digital technology in LLC management; LLC management measures in accordance with the new context, increasingly deep international integration; managing LLCs at border, doing business via e-commerce.
The draft Law dossier is basically assessed to meet the requirements and meet the conditions to be submitted to the National Assembly for consideration and comments.
However, the Committee for Science, Technology and Environment recommends that the agency in charge of reviewing and revising the draft Law ensure consistency in the legal system.
Continue to comprehensively review regulations, guidelines and recommendations in international treaties to which Vietnam is a member to make them legalized, ensuring smooth implementation.
