Accordingly, in the draft Decree of the Government regulating the organization of public service units, the Ministry of Home Affairs clearly stated the authority and responsibility of the Provincial People's Committee, Chairman of the Provincial People's Committee, and the Commune People's Committee.
The draft Decree stipulates that the Chairman of the Provincial People's Committee has the authority and responsibility to decide on the establishment, reorganization and dissolution of public service units according to the provisions of specialized laws;
Stipulate the functions, tasks, powers and organizational structure of public service units as prescribed in Point b, Point c, Clause 3, Article 2 of this Decree according to the provisions of specialized law and public service units as prescribed in Point d, Clause 3, Article 2 of this Decree;
The decision to appoint the Chairman and other members of the Board of Directors in public service units that self-insure regular and investment expenditures and other public service units shall be decided by the Provincial People's Committee according to the provisions of Point b, Clause 1, Article 7 of this Decree.
Meanwhile, the Provincial People's Committee has the authority and responsibility to decide to establish, reorganize, and dissolve the following public service units:
Public service units specified in Point a, Point b, Point c and Point d, Clause 3, Article 2 of this Decree (except for cases where specialized laws have other provisions);
Regulate the functions, tasks, powers and organizational structure (or regulations on organization and operation) of public service units as prescribed in Point a, Point b, Clause 3, Article 2 of this Decree (except for cases where specialized laws have other provisions);
Every year, evaluate the performance of public service units under local management based on criteria, standards for the quality of public service services using the state budget, mechanisms for monitoring, evaluating, quality accreditation and regulations for inspection and acceptance of public service services using the state budget according to the provisions of law.
Decentralization and authorization to perform one or a number of tasks and powers under the authority of the Provincial People's Committee in this Decree in accordance with the provisions of law.
