Accordingly, in the draft Decree of the Government regulating the organization of public service units, the Ministry of Home Affairs proposes to dissolve public service units in cases where there is at least one of the following conditions:
No longer have the function or task of providing public service, serving state management;
Not meeting the criteria and conditions for establishing a public service unit as prescribed by law;
Three consecutive years of ineffective operations as assessed by competent authorities as prescribed by law;
Implement according to the planning approved by competent authorities according to the provisions of law on planning or the Project on network planning of public service units by industry and field approved by competent authorities;
Public service units abroad: In addition to meeting one of the conditions specified in Points a, b, c, and d of this Clause, it is necessary to ensure compliance with the foreign policies of the Party and State and the agreement between the Government of the Socialist Republic of Vietnam and the Government of the host country on the dissolution of public service units.
In addition, the Ministry also proposes that public service units reorganize in cases where there is at least one of the following conditions:
There are adjustments in position, functions, tasks, and powers to comply with the planning approved by competent authorities according to the provisions of law on planning or the Project on network planning of public service units by industry and field approved by competent authorities; ensuring compliance with the regulations on the minimum number of employees as prescribed in Point d, Clause 1 of this Article.
Not meeting the criteria and conditions for establishing a public service unit as prescribed by law;
Not ensuring the level of financial autonomy according to the financial autonomy plan of the unit approved by competent authorities (except in cases where the unit has changes in functions, tasks or changes in the socio-economic situation, changes in policies and regimes or due to force majeure reasons such as natural disasters, epidemics, fires, leading to changes in revenue or expenditure tasks that change the level of financial autonomy);
Other cases as prescribed by specialized law; public service units abroad: In addition to meeting one of the conditions specified in Points a, b and c of this Clause, it is necessary to ensure compliance with the foreign policies of the Party, State and the agreement between the Government of the Socialist Republic of Vietnam and the Government of the host country on the reorganization and operation of public service units.
