This is a notable proposal clearly stated by the Ministry of Home Affairs in the draft Decree of the Government regulating the organization of public service units.
For departments under public service units that self-insure regular and investment expenditures: Number of deputy heads implemented according to the Establishment Project (in case of new establishment) or the autonomy Project of the unit has been approved by competent authorities;
For departments under public service units that self-insure regular expenditures, no more than 2 Deputy Heads of departments shall be arranged;
For departments under public service units that self-insure a part of regular expenditures, public service units with regular expenditures guaranteed by the state budget: From 7 to 9 employees who are civil servants are assigned 1 Deputy Head of Department; from 10 employees who are civil servants or more are assigned no more than 2 Deputy Heads of Department.
In addition, the draft also clearly states the organization of public service units.
Public service units self-guarantee regular expenditures and investment expenditures to decide on the establishment, reorganization, and dissolution of units under their management according to the autonomy project approved by competent authorities, ensuring compliance with the functions and tasks of the unit and meeting the criteria, conditions, and standards prescribed by specialized laws. In case the unit establishes a Management Board, it must be submitted to the Management Board for approval before deciding.
Public service units self-guarantee regular expenditures to decide on the establishment, reorganization, and dissolution of units other than the established units when meeting the criteria and conditions prescribed by law; develop a plan to rearrange the established units and submit it to the competent authority to decide on the establishment of public service units for consideration and decision.
Public service units self-insured for regular expenditures, public service units with regular expenditures guaranteed by the state budget shall develop a plan to arrange and perfect the organizational structure of the unit and submit it to the competent authority for decision to establish a unit for consideration and decision in accordance with the provisions of law;
The establishment of departments, offices and other components that are not public service units (hereinafter referred to as departments) under public service units that self-insure regular expenditures, public service units that self-insure part of regular expenditures and public service units with state budget guarantees for regular expenditures must meet the following criteria: The work or field performed by the department must have 2 or more areas of work and have a separate management process according to the requirements of the management subject; the workload of the department requires the arrangement of 7 or more civil servants.
