Regarding his reflection and proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
The Ministry of Home Affairs said that, according to the provisions of point b, clause 3, Article 13 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants, people who are recruited into civil servant positions in specialist rank positions must have a university degree of 5 years or more and work in a job requiring professional qualifications and nghiệp vụ suitable to the job position expected to be received.
At the Q1/2026 press conference organized by the Ministry of Home Affairs, Deputy Director of the Department of Civil Servants and Public Employees (Ministry of Home Affairs) Nguyen Xuan Tu said: Implementing the Law on Cadres and Civil Servants and the Law on Public Employees in 2025, the Government has issued Decree No. 170 regulating the recruitment, use and management of civil servants.
In which, Article 13 of Decree No. 170 stipulates that in cases of having experience, being admitted to civil service must have 5 years of service or more.
The regulation of the condition of having 5 years of working experience in the Draft Decree of the Government amending and supplementing Decree No. 170/2025 is a continuation of previous regulations of the Law on Cadres and Civil Servants in 2008, the Law amending and supplementing the Law on Cadres and Civil Servants in 2019 and related documents of the Government.
This regulation aims to ensure the quality of the civil servant team when receiving cases working in agencies, organizations, and units with different functions and tasks to become civil servants.
This is a form of reception for cases with practical experience, different from the form of exam or admission according to current regulations" - Mr. Nguyen Xuan Tu said.
Continuing to maintain regulations on 5-year working conditions is to ensure the inheritance and synchronization of the legal system and improve the quality of human resources in the public sector.
