On September 18, in Hanoi, continuing the 7th plenary Session, the Law and Justice Committee conducted a review of the draft Law on Civil Servants (amended) and the draft Law on amending and supplementing a number of articles of the Law on Intellectual Property.
Presenting the Draft Law on Civil Servants (amended), Deputy Minister of Home Affairs Truong Hai Long said that the development and promulgation of the Law to comprehensively innovate the recruitment, use and management of civil servants according to job positions aims to institutionalize the Party's policy on restructuring and improving the quality of the civil service team.
In addition, this also creates a mechanism for connecting human resources between the public and private sectors; attracting and promoting high-quality human resources to improve the operational efficiency of public service units in conjunction with the mechanism of autonomy, self-responsibility, in accordance with the characteristics of the industry and field.
The draft Law adjusts civil servants recruited to work at public service units under the working contract regime, receiving salaries from the salary fund of public service units and from other legal sources according to the provisions of law.
The provisions in the draft Law have innovated the recruitment, use and management of civil servants according to job positions; created connections in the use of human resources between the public and private sectors in conjunction with the implementation of the mechanism of attracting and promoting high-quality human resources; innovated the management of public service units in conjunction with improving the effectiveness of management of civil servant teams.

Approving the comprehensive amendment of the Law on Civil Servants, the opinions of the Law and Justice Committee found that the draft Law dossier had all the documents as prescribed. The content of documents in the draft Law dossier is eligible to be submitted to the National Assembly Standing Committee for consideration and comments.
Regarding the authority to recruit civil servants, there are opinions suggesting regulations in the direction of the authority to recruit civil servants by the competent authority managing public service units according to the decentralization and authorization of the Ministry, branches, and provincial People's Committees.
Based on the level of autonomy and the level of assurance from the state budget for a number of public service units, the Government stipulates the authority to recruit civil servants for these units.
Such a provision is in line with the policy of promoting decentralization; the Law on Teachers has also given the initiative in recruiting teachers to heads of educational institutions to implement or according to the regulations of the Minister of Education and Training, or according to the regulations of the Minister of Public Security, the Minister of National Defense for cases of the People's Armed Forces.
Meanwhile, for the draft Law amending and supplementing a number of articles of the Law on Intellectual Property, the Law and Justice Committee basically agrees with the scope of amendments and supplements of the draft Law.
At the same time, it is recommended to further evaluate the suitability of the amended and supplemented contents with the policies stated in the Government's Submission on ensuring regulations on handling issues arising from new trends in technology and innovation, digital transformation, etc.
