The Ministry of Justice is appraising the draft Decree regulating the organization of public non-business units (DVSNCL) drafted by the Ministry of Home Affairs.
In the draft Decree, the Ministry of Home Affairs proposes regulations on conditions for establishing, reorganizing, dissolving, and transferring public service units.
Accordingly, ĐVSNCL is reorganized in cases where there is at least one of the following conditions:
Adjusting the name, position, functions, tasks, and powers to be consistent with industry planning (if any); or consistent with the network planning of YUs according to the provisions of specialized laws or the orientation of network planning of YUs by industry and field approved by competent authorities; ensuring to improve operational efficiency and meet regulations on the minimum number of employees;
Not meeting the conditions for establishing CBs as prescribed;
Three consecutive years of ineffective operation according to the assessment of competent authorities;
Not ensuring the level of financial autonomy according to the financial autonomy plan of the unit approved by competent authorities, unless the unit has changes in functions, tasks or changes in socio-economic situation, changes in policies, regimes or due to force majeure reasons (such as natural disasters, epidemics, fires) leading to changes in revenue sources or expenditure tasks that change the level of financial autonomy;
For VMNCLs abroad: In addition to meeting one of the above prescribed conditions, it is necessary to ensure compliance with the foreign policy of the Party and State and international treaties between the Government of the Socialist Republic of Vietnam and the Government of the host country on the reorganization and operation of VMNCLs.
One of the important tasks that the Ministry of Home Affairs will implement in the second quarter of 2026 is to continue advising on streamlining the internal organizations of ministries, central agencies and departments and branches in localities.
Notably, the Ministry of Home Affairs also advised on streamlining public service units and state-owned enterprises under leadership and management.
The arrangement of PPPs is being implemented simultaneously from the Central to local levels, with specific orientations for each sector and concentrated progress in the 2026-2027 period.
