The Ministry of Justice is reviewing the Draft Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes, wards and special zones under provincial levels. The draft Decree was drafted by the Ministry of Home Affairs.
The organizational structure of the department and the criteria for establishing organizations under the department are clearly stated in the Draft Decree.
Accordingly, the organizational structure of the department includes: Professional and technical departments; Office (if any); equivalent departments and organizations (if any); Public service units (if any).
Notably, the Ministry of Home Affairs proposes criteria for establishing a professional and technical department under the department, including:
Having the function and task of advising on state management of sectors and fields under the functions and tasks of the department. The workload requires the arrangement of at least 7 civil servant positions.
The criteria for establishing a department-level office are applied according to the provisions of Point b, Clause 2 of this Article. In case no Department Office is established, a specialized department will be assigned to perform the functions and tasks of the Office.
Regarding the criteria for establishing branches and equivalent organizations under the department, the draft Decree states: There are subjects for managing specialized fields and fields under the functions and tasks of the department according to the provisions of specialized laws;
Be decentralized and authorized to decide on issues under state management in specialized fields and fields. The workload requires the arrangement of at least 12 civil servant positions.
Criteria for establishing departments and equivalents under departments: Having the function and task of advising on state management for sectors and fields under the function and task of the department or advising on internal management of the department. The workload requires the arrangement of at least 5 civil servant positions.
